Comments on Findings <br />I. Legal, Financial and Compliance Information - Rule 2.03 <br />The life-of-mine permit term requested in the original permit was <br />denied by the Division, however, all disturbances included in the <br />life-of-mine plan have been approved. These disturbances will be <br />implemented through successive renewal of 5-year terms. <br />The addition of the Section 11 mine plan will not result in a permit <br />boundary change or art increase in the permit area. However it will <br />result in the addition of 114 acres of new disturbance within the <br />currently permitted area. <br />The operation has not been issued any violations since the permit <br />renewal on July 10, 1987, and continues to be in compliance with this <br />section. <br />II. land Use - Rules 2.04.3, 2.03.5, and 4.16 <br />There is no change in the land use sections of the permit. The <br />operation will return the site to the pre-mining land use of rangeland <br />and wildlife habitat, and is in compliance with the requirements of <br />tnis section. <br />III. cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br />In the original permitting process, the area of Section 11 to be <br />disturbed under TR-14 was surveyed for archeological sites and received <br />a clearance for mining. A determination that the present nature of the <br />proposed project {Section 11 mining) is such that no impact upon <br />cultural resources will occur was sent to the Division by the Colorado <br />Historical society an December 15, 1988. The operation is in <br />compliance with the requirements of this section. <br />N . Geology - Rules 2.04.5 and 2.04.6(1) <br />There have been no changes in the baseline geology data for the mine. <br />The operation continues to be in compliance with the requirements for <br />this section. <br />V. Hydrologic Balance: Surface Water - Rules 2.04.5, 2.04,7 <br />There are no significant changes in the surface water section. The <br />operation continues to be in compliance with the requirements of this <br />section. <br />VI. ~drolo ic~c B~ance: Ground Water - Rules 2.04.5, 2.04.7, 2.05.3 <br />sr-- <br />All Division concerns pertaining to this section were resolved during <br />the original permitting. There are no significant changes. The <br />operation is in compliance with the requirements of this section, <br />-2 - <br />
