<br />• <br />Comments on Findings <br />I. Legal, Financial, and Compliance Information - Rule 2.03 <br />In the last three years the following violations have been issued <br />to the North Thompson Creek Mine. <br />NOY C-086-051, issued June 17, 1986, Regulation Section - <br />4.05.1(3), terminated December 8, 1986. <br />zt- <br />NOV C-88-025, issued May '6; 1988, Regulation Section - 4.07.3, <br />termination date June 13, 1988. <br />These two violations have been abated and terminated. <br />Pursuant to Rule 2.07.6(2)(9), the Division finds that Snowmass <br />Coal Company does not own or control any operation which is <br />currently in violation of any law, rule, or regulation of the <br />United States, or of any State law, rule, or regulations enacted <br />pursuant to Federal law, rule, or regulation pertaining to air or <br />water environmental protection, or of any provision of the Surface <br />Mining Control and Reclamation Act or the Colorado Surface Coal <br />Mining Reclamation Act (the Act). <br />The Division also finds, in accordance with Rule 2.07.6 (2 )(h ), that <br />the Snowmass Coal Company does not control and has not controlled <br />any mining operation with a demonstrated pattern of willful <br />violations of the Act of such nature, duration, and with such <br />resulting irreparable damage to the environment as to indicate an <br />intent not to comply with the provisions of the Act. <br />II. Land Use - Rules 2.04.3, 2.05.5 and 4.16 <br />This section of the Findings remains valid for the permit. <br />III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br />This section of the Findings remains valid for the permit. <br />IY. Geology - Rules 2.04.5 and 2.04.6(2) <br />This section of the Findings remains valid for the permit. <br />-3- <br />
