8. Any prairie dogs habitat found on the prope.-ty shall be addressed to the satisfaction of the Colorado <br />Division of Wildlife. <br />9. Pursuant to Section 11.340 of the Adams County Zoning_Reeulations all operation and <br />rehabilitation standards shall be adhered to with the mining and reclamation plans. <br />10. All fuel storage at this site shall be provided with secondary containment, which complies with Sfate <br />of Colorado Oil Inspection Section Regulations. <br />11. All fluid spiIls such as, but net limited to, hydraulic and oil, from maintenance of equipment, shall <br />ba removed and disposed of at a facility permitted for such disposal. <br />12. All haul trucks shall coves their loads pursuant to C,R.S. 42-4-1407. <br />13. The Conditional Use Permit shall apply only to CAMAS Colorado, Inc. or its corporate successors <br />and shall not be transferable to any other party except by amendmenf to the Conditional Use Permit <br />14. No mining shall be permitted within 400-feet of the South Platte River measured to the top of <br />existing bank, or from the top of master plan bank, whichever is furthest away from the river without <br />approval from the Urban Drainage and Flood Control District. Said approval shall be subject to the <br />Technical Review Guidelines for Gravel inning Activities Within or Adjacent to 100-Year <br />Floodplains as adopted in the Adams Count~Zoning Regulations. <br />15. No nvning shall be permitted within 100-feet of the South Platte River measured to the top of <br />existing bank, or from the top of master plan bank, whichever is furthest away from the river without <br />approval of a variance from the Urban Drainage and Flood Control District. In addition, tbe <br />variance shall demonstrate that the applicant can guarantee that they can mine and immediately <br />reclaim the area within the 100-foot setback during one low flow season (generally October through <br />March). <br />16. The mining lake setback from the riverbank is shown as 100 feet. The existing riverbank has not <br />been stabilized. Therefare, in accordance with the mining regulations; the mining setback shall be a <br />minimum of 400 feet from the top of the riverbank, unless adequato documentation is pro~~ided <br />shfswing how, when, and whom will be responsible for the riverbank and pitside bank stabilization. <br />The mining regulations allow for 100 feet setback only if the riverbank and the pitside hank are <br />stabilized. <br />I7. Ail fuel tanks shall be elevated a minimum of one foot above the 100-year flood elevation and <br />installed away from the floodway. <br />18, The temporary overburden and topsoil stockpiles shall be placed a maximum of 20 feet in height and <br />100 feet in width with 100 foot gaps between maximum 300 foot long piles. The piles shall be <br />placed parallel to the overbank flow direction. 1n addition, the piles or any other development within <br />the floodway will be prohibited urdess hydraulic modeling of the 100-year flood shows no increase <br />in the 100-year flood elevation. <br />
