<br /> <br />1 <br />' 7. Adams County Pazks requests that the area be surveyed for Preble's Meadow Mouse and Ute <br />Ladies-tresses orchid habitat and receive US Fish & Wildlife Service approval. Until such time as a <br />statement of disqualification is received by the US Fish and Wildlife Service, raining operations will <br />be set back 300 feet from any area identified as potential habitat. <br />8. The applicant shall revise the reclamation plan to include fire preservation or replacement of medium <br />and large native trees that exist on the site. <br />9. The applicant shall provide a detailed legal description of the right-of--way area to be vacated and a <br />' draft warranty deed for review by the Department of Public Works. <br />10. The applicant shall execute a road maintenance agreement with Adams County. _. <br />' Stipalatlons: <br />1. If track traffic is maintained on Riverdale Road, for ties expansion, drivers must fo]low the speed <br />1 limit and make a complete stop at Highway 7. Drivers not following traffic laws shall be denied <br />loading at the pit by the operator. <br />2. Fueling areas shall be separated from the reset of the site's surface area, and protected from <br />stormwater. <br />3. Fugitive dust control mechanisms must be in place, and functioning at all times. <br />4. All complaints received by the applicant concerning impacts to offsite wells, dad the resolution of <br />those complaints, shall be conveyed to the Department of Plamting and Development. impacts to <br />offsite water wells, from de-watering activities, shall be responded to and resolved immediately by <br />the applicant. Disputes concerning impacts to offsite water wells may be resolved by the <br />Department of Planning and Development, Arid gray be justifecation far a Shaw Canso Hsaring <br />before the Adams County Board of County Commissioners. The applicant shall have the burden of <br />establishing that the off-site well is not affected by applicant's operation. <br />5. This site is subject to inspections from Adams County inspectors, during reasonable working hours. <br />Adams County may give notice of inspection prior to the inspection. <br />6. Adams County's "South Platte River Heritage Plan" recognizes this area suitable for gravel mining <br />and water storage. The Plan also recognizes significant wildlife habitat immediately to the north <br />suitable for conservation areas. The applicant will coordinate plans with the Department of Pazks <br />and Community Resources to set aside areas for a wildlife habitat and conservation area. <br />7. Adams County's "South Platte River Heritage Plan" recognizes this area as a movement corridor for <br />many species of wildlife. Adams County Department of Parks and Community Resources <br />recommends minimal fencing be used which would impede wildlife movement up and down the <br />river corridor. <br />
