<br /> <br />-28- <br />XXI. Bonding - Rules 2.05.9(2)(b) and 3 <br />Sundance Coal Company has agreed to post a performance bond in the amount of <br />5135,000.00. The Division has determined that this amount will be sufficient <br />to cover the cost of reclamation at the Rnimas Mine. <br />Pursuant to Rules 2.07.6(2)(j) and 3.02.I(1), the performance bond in this amount <br />will be filed with the Division, payable to the State of Colorado, before a <br />permit will be issued. <br />The operation is in compliance with the requirements of this section. <br />XXII. Sealing of Drilled Holes or Underground Openings - Rules 2.05.4(2)(g) <br />and 4.07 <br />The applicant has described how portals will be sealed, how exploration or other <br />drill or bore holes and wells will be managed or sealed and has committed to <br />submitting abandonment reports to the Division within 60 days after abandonment <br />of any hole, well, or underground opening. This information can be found in <br />Sections 2.05.4 (D) and 4.07.3 (pages 219-217 and 266) of the permit application. <br />The proposed operation is in compliance with the requirements of the Act and <br />the Rules and Regulations. <br />XXIII. Subsidence - Rules 2.05.6(6) and 4.20 <br />Information regarding subsidence for the Animas Mine operation is provided in <br />Section 2.1.6(6) of the permit application. The applicant states that no <br />structures or renewable resource Lands exist within the proposed permit and <br />adjacent areas. The Division concurs with that opinion. The applicant is, <br />therefore, in conformance with the requirements of Rules 2.05.6(6) and 4.20. <br />No subsidence monitoring is required for this operation. <br />The operation is in compliance with the requirements of this section. <br />XXIV. Special Categories of Mining - Rules 2.06, 4.22, 4.23, 4.26, 4. <br />4. <br />The applicant does not plan to use any support facilities not located at the <br />mine site. Since this is an underground mine, provisions pertaining to <br />mountaintop removal, steep slope mining, and angering operations are not <br />applicable. No in situ coal processing will take place. <br />The proposed operation is in compliance with the requirements of these sections. <br />
