_2~_ <br />Stipulation No. I2: <br />WITHIN 30 DAYS AFTER PRODUCTION OF THE FIRST COAL PROCESSING WASTE, <br />THF, MATERIAL MUST BE SAMPLED AND ANALYZED FOR GEOCHEMICAL CHARACTER- <br />ISTICS. THIS ANALYSIS WILL INCLUDE THE FULL SUITE OF PARAMETERS WHICH <br />IS REQUIRED BY THE DIVISION AT THAT TIME, AS SPECIFIED IN CURRENT <br />DIVISION GUIDELINES FOR ROOF AND FLOOR CHEMICAL PARAMETERS. AFTER <br />6 P1ONTH5 FROM THE INITIAL SAMPLING, NEW COAL PRLL^ESSING WASTE WILL <br />BE SAIdPLED AND ANALYZED FOR THE APPROPRIATE PARA1•fETERS. ALL <br />ANALYSES WILL BE SUBMITTED TO THE DIVISION WITHIN 30 DRYS OF SAMPLING. <br />The following stipulation, regarding monitoring of ground water impacts of the <br />coal processing waste pi 1e, is also required: <br />Stipulation No. 13: <br />PRIOR TO PLACEMENT OF ANY WASTE MATERIAL, THE PER1dITTEE MUST DEVELOP <br />THE' COAL DEVELOPMENT WASTE PILE MONITORING WELLS AS PROPOSED IN THE <br />GROUND WATER MONITORING PLAN IN THE PERMIT APPLICATION. IN THE <br />PROCESS OF DEVELOPING THESE WELLS, THE APPLICANT MUST 1) VERIFY <br />DEPTH TO BEDROCK, 2) DETERMINE THE TYPE AND STABILITY OF THE BEDROCK, <br />AND 3) DETERMINE THE DEPTH AND QUALITY OF ANY GROUND WATER ENCOUNTERED <br />IN THE WELLS. ADDITIONALLY, THESE WELLS MUST BE CASED AND ffONITORED <br />MONTHLY FOR GROUND WATER LEVELS. IF GROUND F/ATER IS PRESENT, SAMPLES <br />MUST BE TAKEN QUARTERLY AND ANALYZED FOR THOSE PARAMETERS REQUIRED BY <br />THE DIVISION AS SPECIFIED IN CURRENT DIVISION GUIDELINES FOR GROUND WATER <br />QUALITY PARAMETERS. RESULTS OF ALL INVESTIGATIONS AND ANALYSES MUST <br />BE SUBMITTED TO THE DIVISION IN A TIMELY MANNER. <br />With the acceptance of the above stipulations, the proposed operation is in <br />compliance with the requirements of this section. <br />XIX. Mine Facilities, Coal Handling Structures, Support Facilities - <br />Ru1es 2.05.3(3), 2.05.3(7) and 4.04 <br />The applicant has described the construction, use, maintenance, and removal of <br />the mine office, warehouse, bathhouse, truck scale, stackers, conveyors, breaker, <br />preparation plant, fan, portal structures, substation, coal stockpiles, waste <br />rock pile, and the parking lot in Sections 2.05.3(3) and 2.05.3(7) (pages <br />149-154 and 193-198) of the permit application. <br />These sections are in compliance with the requirements of the Act and the Rules <br />and Regulations. <br />XX. Roads - Rules 2.05.3(3)(e)(i) and 4.03 <br />The discussion on construction and drainage of the haul road of the mine site is <br />given in Section 2.05.3(3) (page 89) of the permit application. A11 aspects of <br />the road construction and drainage are in compliance with the requirements of <br />Rule 4.03.1 of the Rules and Regulations. <br />The operation is in compliance with the requirements of this section. <br />
