<br />-26- <br /> <br />XVIZI. Coal Processing Waste and Non-Coal Processing Waste - Rules 2.05.3(8), <br />2.05.9(2)(f), 4.10 and 4.I1 <br />Sun dance Coal Company has provided information regarding a coal processing waste <br />disposal pile in Section 2.05.3(8) of the permit application. The site will <br />accommodate coai processing waste generated by a heavy media wash plant, as <br />well as incidental roof fall material. The final configuration of the pile will <br />be a terraced slope which meets the requirements of Rule 4.22.2(2). <br />The applicant has provided a stability analysis of the coal processing waste <br />pile which demonstrates that the pile will meet the stability requirements of <br />Rule 4.14.2(1)(b). Although the assumptions used in the analysis were conservative, <br />they were not based on actual characteristics of the material. For this reason, <br />the following stipulation is required for a finding of compliance with this <br />section: <br />Stipulation No. 10: <br />WITHIN 30 DAYS AFTER PRODUCTION OF THE FIRST COAL PROCESSING WASTE, <br />THE MATERIAL MUST BE ANALYZED TO ACCURATELY DETERMINE THE PARAldETERS <br />USED IN THE STABILITY RNALI'SIS, RND THE RESULTS OF THE ANALYSIS <br />MUST BE SUBI9ITTED TO THE DIVISION. ZF THE RESULTS OF THE ANALYSIS <br />NECESSITATE A CHANGE IN THE CQAL PROCESSING WRS TE EMBANKMENT DESIGN, <br />APPROPRIATE CHANGES F1UST BE INCORPORATED INTO THE FINAL DESIGN. <br />The applicant has committed in the application to the placement of four feet of <br />non-toxic material over the permanent waste disposal pile following construction. <br />However, the applicant has not demonstrated whether sufficient material is <br />available either on site or otherwise. For this reason, the following <br />stipulation is required: <br />Stipulation No. 11: <br />WITHIN 30 DAYS OF PERMIT ISSUANCE, BUT PRIOR TO THE DISPOSAL OF ANY COAL <br />PROCESSING WASTE PRODUCED BY THE OPERATION, THE PERMITTEE MUST DEMONSTRATE, <br />TO THE SATISFACTION OF THE DIVISION, THAT ENOUGH NON-TOXIC MATERIAL <br />IS AVAILABLE TO THE PERMITTEE TO PROVIDE AT LEAST FOUR FEET OF COVER <br />OVER THE PERMANENT COAL PROCESSING WASTE PIT.E FOLLOWING CONSTRUCTION <br />OF THE PILE. <br />This requirement for four feet of cover may be modified by the Division on the <br />basis of the results of the analyses required in the following discussion. <br />The applicant has supplied geochemical data for the material which will be <br />disposed of in the coal processing waste embankment. The material sampled, <br />however, was removed from old mine workings which may have been subject to <br />weathering for extended periods of time. For this reason, the Division is <br />requiring re-sampling of the material to determine geochemical characteristics. <br />The following stipulation is, therefore, required: <br />
