~~ <br /> <br />-2s- <br />Pursuant to Rule 2.07.6(2)(n) and on the basis of available information, the <br />Division finds that the proposed operation will not affect the continued <br />existence of endangered or threatened species or result in the adverse <br />modification or destruction of their critical habitats. <br />The operation is in compliance with the requirements of this section. <br />XIV. Prime Farmland - Rules 2.04.12, 2.06.6 and 9.25 <br />The Division has made a negative determination for the presence of prime farm- <br />lands within the proposed permit area. The decision was based on_the evidence <br />provided by the Soil Conservation Service that there are no prime farmlands <br />within the proposed permit area because of the existence of steep slopes and <br />shallow, gravelly soils. This evidence can be found in Section 2.04.12 of the <br />permit application. <br />The Division, therefore, finds the operation in compliance with Rule 2.07.6(2)(k) <br />with respect to prime farmlands. <br />XV. Operations Description - Rules 2.05.2, 2.05.3(1), 2.05.3(2) and 4.01 <br />The mine operations general description can be found in Section 2.03.2 (pages <br />143-148) of the permit application. <br />The proposed operation is in compliance with the requirements of this section. <br />XVI. Explosives - Rules 2.05.3(6)(a) and 4.08 <br />The applicant does not plan to conduct any surface blasting activities. <br />Explosives are not planned to be stored at the surface. <br />The proposed operation is in compliance with the requirements of this section <br />of the Rules and Regulations. <br />- Rules 2.05.3(6)(b), 2.05.4(2)(a), 2. <br />09 <br />She applicant has provided information on backfilling and grading in Sections <br />2.05.3(6) and 2.05.4 of the permit application. Backfillinq and grading <br />operations will pertain primarily to the reclamation of the portal areas. <br />Details of grading and stability of the coal processing waste disposal pile are <br />given in Section XVIZI of this Findings Dociurent. <br />The bench and portal areas will be regraded to approximate original contour. <br />The applicant has provided sufficient analyses to demonstrate that the reclaimed <br />surface will meet the stability requirements of Rule 4.14.2(1)(b). <br />The operation is in compliance with the requirements of this section. <br />
