• <br />_29_ <br />i <br />The applicant has not supplied a revegetation plan, but has committed to <br />working with the Division to establish an acceptable plan. For this reason, <br />the following stipulation is necessary: <br />Stipulation No. 9: <br />WITHIN 90 DRYS OF PERMIT ISSUANCE, THE PERMITTEE SHALL <br />PROVIDE THE FOLLOWING: <br />1. ASITE-SPECIFIC REVEGETRTION PLAN WHICH ADDRESSES AT A MINIIfUM <br />THE FOLLOWING: A SCHEDULE FOR REVEGETATION, SEED MIXES TO BE <br />USED RT THE SITE FOR REVEGETATION, TOPSOIL STABILIZATION, <br />EMBANXh1ENT SEEDING AND OTHER APPLICATION, PLANTING AND SEEDING <br />METHODS, 1•fULCHING TECHNIQUES, IRRIGATION MEASURES, AND <br />PEST AND DISEASE CONTROL MEASURES. <br />2. MEASURES TO BE USED TO DETERMINE THE SUCCESS OF REVEGETATION <br />IN ACCORDANCE WITH RULE 4.15.7 AND 4.15.8, TO INCLUDE, BUT NOT <br />BE LIMITED TO: METHODOLOGIES E1fPLOYED TO MEASURE SUCCESS, <br />STANDARDS FOR COVER, PRODUCTIVITY, WOODY PLANT DENSITY, AND <br />SPECIES DIVERSITY, AND A GRAZING MANAGEAfENT PLAN. <br />Pursuant to Rule 2.07.6(2)(n) and based on available information, the Division <br />finds that the mining and reclamation operations will not result in the destruction <br />or adverse modification of any critical habitat or affect the continued existence <br />of any species of threatened or endangered plant. <br />With the acceptance of the above stipulations, the operation is in compliance <br />with the requirements of this section. <br />XIII. Fish and Wildlife - Rules 2.09.11, 2.05.6(2) and 4.18 <br />The fish and wildlife resource statement and the fish and wildlife management <br />plan sections of the application are found in Sections 2.04.11 and 2.05.6(2) <br />(pages 76 and 135). <br />The Division has consulted with personnel from the Colorado Division of Wildlife <br />(DOW) with respect to the Animas Mine. Based upon the consultation, it has <br />been determined that there are no major wildlife concerns for this operation. <br />The mine is located in, or near, an area that has been designated as potential <br />hunting and nesting sites for the American Peregrine Falcon, an endangered <br />species. DOW has not located any nesting sites within or adjacent to the surface <br />disturbance associated with the mine. The value of this area as hunting grounds <br />is very limited due to the previous disturbance at the site and the proximity <br />to the city of Trinidad. <br />There are large tracts of undisturbed land near the mine site. These undisturbed <br />Lands provide good hunting and nesting sites. Therefore, the loss of the <br />Animas mine site as a hunting area for the Peregrine Falcon has very little <br />relative impact. <br />
