C <br /> <br />_2g- <br /> <br />XXV, Miscellaneous Compliance - Rules 2.05,6(5), 9.02, 9.12, 4.I9, 9, 2I, <br />9,28 and 4,30 <br />The applicant will not be conducting surface mining near underground mining. <br />Off-site support facilities have been addressed in the previous section (Section <br />XXSV) of this Findings Document. The applicant has committed to proper <br />placement and maintenance of all necessary signs and markers and meeting all <br />requirements for temporary and permanent cessation of operations. The <br />applicant has also presented a discussion of potential exploration activities. <br />This information can be found in Sections 4.02 and 9.21 (pages 264-265 and <br />267-270) of the permit application. <br />The proposed operation is in compliance with the requirements of these sections <br />of the Rules and Regulations. <br />XXVZ, Operations on Lands Subject to Prohibitions or Limitations - <br />The proposed operation is in compliance with the requirements of these sections <br />and Rule 2.07,6(2)(d) for the following reasons: <br />1. The permit area of the proposed operation is not within: <br />a. an area designated unsuitable for mining; <br />b. an area under study for designation as unsuitable for surface coal <br />mining; or <br />c. on any lands subject to prohibitions or limitations. <br />2. The permit area of the proposed operation is within 300 feet of an occupied <br />dwelling, but the applicant has submitted the documentation required by <br />Rule 2.07.6 (2) (d) (v) . <br />XXVII. Demonstration that Surface Coal Mining and Reclamation Operations Can <br />Re Feasiblu Accamolished - Rule 2.07.6(2)(b) <br />Contingent upon the satisfactory resolution of stipulations presented in this <br />Findings Document, the following finding of compliance is presented: <br />Pursuant to Rule 2.07.6(2)(b), the Division finds, based on information in the <br />application and fmm all available sources, that surface coal mining and <br />reclamation operations can be feasibly accomplished under the mining and <br />reclamation plan contained in the application. <br />XXVI17. Compatibilito_With Anticipated Adiacent Operations - Rule 2.07.6(2)(1) <br />Pursuant to Rule 2.07.6(2)(1), the Division finds that Sundance Coal Company <br />operations will not be inconsistent with any other operations anticipated to be <br />performed in areas adjacent to the permit area. <br />At this time there are no anticipated adjacent operations. <br />The proposed operation is in compliance with the requirements of this section. <br />
