,, <br />Please update the surface ownership information in Tab 3 and Exhibit 3-I of the <br />permit to reflect any changes that have occurred. <br />3. Listing of subsurface owners appears to need updating. A recent check of the <br />Rout County records by the Division found what appeared to be a change in mineral <br />ownership contiguous to the permit boundary, as follows: <br />New owners Former owners <br />Cannon Oil Hereford Haven <br />Please update subsurface owner information in Tab 3 and Exhibi[ 3-2 of the permit to <br />accurately reflect any changes that have occurred. <br />4. Tab 20 of the permit application contains out-dated references to shrub density <br />standards, as noted by the permittee in a letter to the Division dated June ]l2, <br />1998. In that letter, the permittee proposes to delete outdated wording in Tab 20 that <br />refers to a shrub density standard. Also proposed for deletion from page 13 is that <br />part of the diversity requirement in [he upland rangeland area that requires a 10% <br />frequency of occurrence for shrubs. The rationale offered for deleting the 10% <br />frequency requirement is that the requirement contradicts language elsewhere on page <br />13 (and on other pages) that says the Loadout does not have a woody shrub density <br />standard. <br />The Division agrees the out-dated language referring to shrub density should be <br />deleted, but believes removal of the 10% frequency requirement is not warranted. The <br />Division believes at least a minimal demonstration of shrub re-establishment is <br />necessary. Please make the deletions marked on [he attached copy of page 10. <br />5. Page 10 of Tab 20 does not explain how species frequency will be determined. <br />The Division believes shrub plants seen along and next to transect lines can count for <br />frequency even though not actually hit in the count, and suggested, possible, warding <br />to this effect is shown in handwriting on the attached copy of page 10.
