<br />Additional Midterm Review Items <br />The attached "Checklist of Additional Midterm Review Items" surnmarizes the results of the <br />Division's review of items that have no specific requirement in the Regulations requiring <br />their review. <br />Bond <br />No bond releases have occurred at the Loadout. The Division reviewed estimated <br />reclamation costs for the Loadout in July 2000, and verified the adequacy of that estimate <br />in January 2001. The Division approved a reduction in the Loadout's bond liability on <br />July 24, 2000. The amount of the bond reduction was for $35,240.00, resulting in <br />remaining bond liability of $826,880.00. The reduction resulted from an updated estimate <br />of reclamation costs at the Loadout that was provided by the permittee in connection <br />with Technical Revision TR-9 (modification of the coal handling facilities). <br />The bond liability amount of $826,880.00 is sufficient to assure completion of the remaining <br />reclamation work at the site if the work had to be performed by the Division, including the <br />cost of reestablishing vegetation on any revegetated areas, should those areas fail. The <br />permittee currently has on deposit with the Division a corporate surety bond in the amount <br />of $862,120.00, an amount sufficient to cover the $826,880.00 bond liability. <br />PART III -REQUESTED REVISIONS OF PERMIT APPLICATION <br />Based on the current Midtetm Review, the Division finds that permit application C-92-081 <br />contains the five deficiencies described below. As a result of these findings, and to correct <br />the deficiencies, the Division requests that the permittee submit revised permit pages in a <br />Minor Revision by April 30, 2001. Each change is requested to ensure compliance with <br />Section 2.03.3(1) which requires that all information in the permit application be current and <br />presented clearly. <br />1. Resolution of Permit Stipulation ST-6. In an effort [o resolve ST-6, please advise <br />the Division of the current status of the items referred to in the stipulation: the bond <br />forfeiture and violations (050265, 050320, 052522, and 052908) associated with <br />Kentucky permit 8980140. <br />2. Listing of surface owners appears to need updating. A recent check of the Routt <br />County records by the Division found what appeared to be a change in land ownership <br />contiguous to the permit boundary, as follows: <br />New owners <br />Robert Keith and Diane L.
