XXIII. Special Categories of Mining - Rules 2.06, 4.22, 4.23, 4.26, 4.27, 4.28 <br />en - - -- - <br />Under the permit renewal allowing only reclamation, the applicant will not be <br />using a loadout off the permit area. Therefore Stipulation No. 18 is no <br />longer required. No other rules under this section apply to this renewal. <br />The proposed operations are in compliance with the requirements of this <br />section. <br />XXIV. Miscellaneous Compliance - Rules 2.03.3, 2.05.6(5), 4.02, 4.12, 4.19, <br />an <br />A review of the permit renewal documents indicates that the rules of this <br />section have been complied with. <br />Stipulation No. 19 required incorporation of responses and changes from the <br />permit review process into the permit application documents located at the <br />MLRD offices. It appears that the referred-to materials have been inserted, <br />therefore this stipulation is being removed from the renewal findings. <br />The proposed operations are in compliance with the requirements of the rules <br />in this section. <br />XXV. Operations on Lands Subject to Limitations or Prohibitions - Rules <br />a~ <br />As demonstrated on page 2.03-16 (revised 12/86) and page 2.10-1 of the permit <br />application of 1983, the proposed operation is in compliance with the <br />requirements of these sections and 2.07.6(2)Id) for the following reasons: <br />1. The proposed permit area is not: <br />a. Within an area designated unsuitable for surface coal <br />mining operations; <br />b. Within an area under study for designation as unsuitable <br />for surface coal mining operations; <br />c. On any lands subject to prohibitions or limitations; or <br />d. Within 300 feet, measured horizontally, from an occupied <br />dwelling. <br />XXVI. Demonstration That Surface Coal Mining And Reclamation Operations Can <br />e ease y ccomp is a- u e <br />The Division finds, pursuant to Rule 2.07.6(2)(b), based on information in the <br />application and from all available sources, that surface coal mining and <br />reclamation operations can be feasibly accomplished, subject to the approvals <br />and stipulations in this Findings Document, under the Mining and Reclamation <br />Plan contained in the permit application. <br />-14- <br />
