XVIII. Coal Processing Waste and Non-Coal Processing Waste - Rules 2.05.3(8)
There will be no coal processing waste produced under this renewal, therefore
Stipulation No. 12 which requires sampling and analysis of coal waste is no
longer needed. The application is in compliance with the requirements of this
sec ti on.
XIX. Mine Facilities, Coal Handling Structures, Support Facilities - Rules
an
Under the permit renewal there will be no mine or support facilities or
structures present on the site. The Division finds the application to be in
compliance with the requirements of this section.
XX. Roads - Rules 2.05.3(3) and 4.03
No roads will be built under this renewal, therefore Stipulation No. 13 is no
longer required. The remainder of the 1983 Findings Document remains in
effect. The Division finds the application to be in compliance with the
requirements of this section.
XXI. Bonding - Rule 2.05.4(2)(b)
The current bond amount posted for this mine is E348,401.18.
The permit renewal application, received on November 15, 1988 and Kaiser
Steel's responses to the Division's adequacy comments for TR-9 and Permit
Renewal No. 1 received on January 20, 1989, contained cost estimates for the
reclamation work described in TR-9. Because the approved mining never took
place, except for the exploration pit, much less disturbance has occurred than
was originally bonded for. Therefore, under this renewal, the required bond
has been reduced.
The latest estimates by the Division indicate that the reclamation work to be
done under the permit renewal would cost approximately 5250,000.00. Therefore
the Division, as part of the renewal process, will accept a bond reduction to
a total of 5250,000.00.
Stipulation No. 16, requiring the increase of the reclamation bond to
5345,260.00, has been complied with. The Division currently holds bonds for
this mine in excess of that amount. Therefore Stipulation No. 16 is no longer
necessary.
The operation is in compliance with the requirements of this section.
XXI I. Sealing of Drilled Holes and Underground Openings - Rules 2.05.4(2)(
No changes will be made to this section. Stipulation No. 17 will remain in
effect.
-13-
