4, Stipulation No. 9 required the establishment of a species
diversity standard. The standard which was agreed upon is the
establishment of 2 cool season grasses, 2 warm season grasses, 2
fortis, and 2 species of woody plants; no single species
comprising more than 40 percent relative cover nor less than 3
percent relative cover on the revegetated area. This standard is
described on page 2.05-46 (c) of the permit application and
accepted by Perma by their letter to the Division on
July 16, 1985 (see page 2,05-46(a) of the permit application).
Therefore this stipulation is no longer necessary.
The remainder of this section is as presented in the 1983
Findings Document. The Division finds this section to be in
compliance.
XIII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2) and 4.18
There are no changes to this section. The application is in compliance with
the requirements of thi s section.
XIV. Prime Farmland
There are no changes to this section. The application is in compliance with
the requirements of this section.
XV. Operations Description - Rules 2.05.2, 2.05.3(2) and 4.01
With the implementation of the approved reclamation plan, the only operations
will be the sealing of monitoring wells; back filling of the test pit,
diversion ditches and sediment ponds; demolition of the office building; and
the topsoiling and revegetation of these areas.
These activities are described in greater detail on the revised pages 2.02-8
through 2".02-12 of the permit application, submitted by letter of
January 18, 1989 by Kaiser Steel in response to the Division's adequacy
comments.
This proposed reclamation plan, however, does not contain a reclamation
schedule. As a result, the Division imposes the following stipulation:
Stipulation No. 22
RECLAMATION OF THE MINE, FOLLOWING THE APPROVED RECLAMATION PLAN, WILL
BEGIN AND WILL BE COMPLETED DURING THE FIRST NORMAL CONSTRUCTION SEASON
FOLLOWING THE DIVISION'S APPROVAL OF THE RENEWAL OF THE PERMIT.
With the acceptance of this stipulation, the proposed operation is in
compliance with the requirements of this section.
-11-
