4, Stipulation No. 9 required the establishment of a species <br />diversity standard. The standard which was agreed upon is the <br />establishment of 2 cool season grasses, 2 warm season grasses, 2 <br />fortis, and 2 species of woody plants; no single species <br />comprising more than 40 percent relative cover nor less than 3 <br />percent relative cover on the revegetated area. This standard is <br />described on page 2.05-46 (c) of the permit application and <br />accepted by Perma by their letter to the Division on <br />July 16, 1985 (see page 2,05-46(a) of the permit application). <br />Therefore this stipulation is no longer necessary. <br />The remainder of this section is as presented in the 1983 <br />Findings Document. The Division finds this section to be in <br />compliance. <br />XIII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2) and 4.18 <br />There are no changes to this section. The application is in compliance with <br />the requirements of thi s section. <br />XIV. Prime Farmland <br />There are no changes to this section. The application is in compliance with <br />the requirements of this section. <br />XV. Operations Description - Rules 2.05.2, 2.05.3(2) and 4.01 <br />With the implementation of the approved reclamation plan, the only operations <br />will be the sealing of monitoring wells; back filling of the test pit, <br />diversion ditches and sediment ponds; demolition of the office building; and <br />the topsoiling and revegetation of these areas. <br />These activities are described in greater detail on the revised pages 2.02-8 <br />through 2".02-12 of the permit application, submitted by letter of <br />January 18, 1989 by Kaiser Steel in response to the Division's adequacy <br />comments. <br />This proposed reclamation plan, however, does not contain a reclamation <br />schedule. As a result, the Division imposes the following stipulation: <br />Stipulation No. 22 <br />RECLAMATION OF THE MINE, FOLLOWING THE APPROVED RECLAMATION PLAN, WILL <br />BEGIN AND WILL BE COMPLETED DURING THE FIRST NORMAL CONSTRUCTION SEASON <br />FOLLOWING THE DIVISION'S APPROVAL OF THE RENEWAL OF THE PERMIT. <br />With the acceptance of this stipulation, the proposed operation is in <br />compliance with the requirements of this section. <br />-11- <br />
