2. Rule 2.03.4(3)(c). Please update this section to include the date each officer assumed <br />their respective position. <br />Rule 2.03.4(3)(d). Include a statement as to whether Mr. Kirkwood has or currently owns <br />or controls any other coal mining or reclamation operations in the United States. )f so, <br />complete Rule 2.03.4(3)(e). <br />3. Rule 2.03.5, page I. Please update the compliance information to include NOV C-94-005 <br />dated March 31, 1994 and indicate that it was vacated by the Division. <br />4. Rule 2.03.6. From a review of the leases, it appears that 1,894 acr>rs, more or less, are <br />leased for mining operations. Are all leases still in effect, and is this information <br />correctly depicted on the maps as the permit boundary? Also, please insure that the mine <br />has right of entry for all lands in the permitted boundary. <br />5. Rule 2.04.3(2)(a). Please prepare a land use map in accordance with (IAW) Rule 2.10. <br />Rule 2.04.3(3)(a) to (f). Add a brief description of all the old workings within the <br />permitted area. <br />6. Rule 2.04.5(1). Please revise the statement on page one of Section 2.04.5 of the permit <br />document to also refer to Maps C-10 and C-11. Please also revise Map C-11 to include <br />the King Coal Mine permit boundary (Rule 2.10.1(3)) and the Huntington Ditch. <br />7. Rule 2.04.7, page 3. The last sentence is difficult to interpret. A change to state that <br />"Intake water used inside the mine is not pumped out or discharged" may clear the matter <br />up. <br />Rule 2.04.7, page 5. Please update the list of permitted wells in the vicinity and include <br />wells up to a mile from the permit boundary. <br />Rule 2.04.7(4)(a) to (g). Please prepare a Regional Hydrology Map (I.4W Rule 2.10) that <br />provides information in parts (a) to (g) and include the wells identified in the paragraph <br />above. <br />8. Rule 2.04.8, page 1, paragraph 3. Please update the precipitation amounts to reflect the <br />following: 10-year, 24-hour event is 2.2 inches; 25-year, 24-hour event is 2.6 inches; and <br />the 100-year, 24-hour event is 3.2 inches. <br />9. Rule 2.05.3(5). Please include a statement that indicates that since the mine was apre- <br />law site that began operations in the 1940's, no topsoil was salvaged. However, a topsoil <br />borrow area has been designated and shown on Map C-4. <br />10. Rule 2.05.4, page 2. Please list and depict on the appropriate map the location of all <br />vent/arr shafts or holes. <br />Rule 2.05.4, page 3, paragraph 2. Please delete the word "coal" from...zero to 12" thick) <br />of coal, shale... <br />Rule 2.05.4, page 3, paragraph 5.
