~ S <br />Rule 2.05.492)(c). As it is the intention to leave the maintenance shop building and <br />therefore the north-facing highwall, additional information is requrred. Please provide the <br />approximate date the highwall was constructed and cross sections of the highwall area <br />showing the highwall, road, shop, and bench area. Additionally, provide a report <br />prepared by a P.E. that the highwall meets a minimum static safety factor of 1.3. <br />I1. Rule 2.05.6(6)(a). Please revise the title of the first paragraph on page 2 of <br />Section 2.05.6 from "Subsidence Survey" to "Inventory of Structures and Renewable <br />Resource Lands." <br />Additionally, please modify the current inventory of structures to reflect the existence of <br />all buildings (including the mine's surface facilities), the old Burnwell Tipple, the wells, <br />"x" feet or miles of fence, and the two-track dirt road running through the mesa. <br />Rule 2.05.6(6)(b). Please modify the current "Description of Worst Possible <br />Consequences of Subsidence" to include a description of the worst possible consequences <br />which subsidence, if it occurred, could have for all the newly added structures. In the <br />case of the mine facilities area and wells, you could state that since the underlying area <br />was not mined, there will be no subsidence that will affect these structures. For the <br />barbed wire fence and dirt road, state what could possibly happen and how you could <br />effect repairs. <br />Please have your P.E. provide designs and cross sections for the permanent reconstructed <br />drainage channel and depict the location on the fmal reclamation contour map. This <br />would include both the east and west channels. Please be aware that the culvert system <br />that currently diverts the west channel could be left in place provided that a P.E. certifies <br />that the culvert system could safely discharge the designed 100-year event and the land- <br />owner provides a written statement that he not only wants the system left in place, but <br />will assume all maintenance and liabilities for the structure after NKC's 10-year liability <br />period is concluded. <br />12. Rule 2.10.3(2). Please ensure that all maps, plans, and cross sections included in the <br />permit application required by Rule 2.10 are prepared by or under the direction of, and <br />certified bv, a qualified registered professional engineer or professional geologist. <br />Section V -Bonding Summary <br />The Division currently holds $100,000.00 in corporate sureties for the reclamation performance <br />bond at the King Coal Mine. The performance liability for the site, not including the proposed <br />new portal entrances, has been calculated at $72,000.00.
