Mr. Dave Stout - 4 - April 15, 1985 <br />II. Golden Eagle Mine <br />A. Stipulations <br />Stipulations 1, 3, 4, 5, 6, 7, 15, 18, 19, 22, 23, 25, and 29 <br />have been satisfied. Additional comments on submittals <br />pursuant to Stipulations 2, 5, 6, and 23 may be found under <br />New Elk Stipulations 3, 8, 9, and 27, respectively. <br />Extensions have been granted for Stipulations 16, 17, 20(G), <br />21, and 27. Again, all future extensions will be considered <br />as minor revisions. <br />The monitoring requirements for Stipulations 1, 10, 11, and 13 <br />are being fulfilled. The monitoring report for Stipulation 28 <br />is expected shorty. The proposed submittal dates for <br />Stipulations 8, 12, and 14 have been accepted. <br />The Division has requested additional information for <br />Stipulations 9, 24, and 26. Responses for Stipulations 24 and <br />26 were to have been submitted in March of 1985. <br />8. Minor Revision <br />I have reviewed both your request for a minor revision to <br />relocate the light use road, and the Division's response of <br />March 1. The uses of the road in question, which include <br />monitoring, pond maintenance, and rock dust hauling, indicate <br />a situation that is borderline between the classifications of <br />access and light use. Since the original road was classified <br />as light use, the Division will accept the same classification <br />for the new road. You may wish to consider that by <br />classifying the air shaft road as an access road, Wyoming Fuel <br />Company could increase the flexibility of potential road uses, <br />without substantial change in design. Under the present <br />classification as a light use road, any additional traffic <br />above the current use frequency would be prohibited. <br />A technical review of the proposed revision has found several <br />inadequacies in the plan. In order to evaluate road <br />construction with respect to the Act, additional information <br />is required on the following: <br />1. The exact construction techniques to be used, compaction <br />specifications, and a cross section of worst case <br />cut-and-fill are required. Phrases such as "may or may <br />not be used" do not enable the Division to evaluate <br />proposed construction. <br />
