The location and volume of <br />alternate material should be identified as needed, in order to <br />meet the reapplied topsoil depth specifications. <br />The seed mix proposed in the stipulation response (Volume I of <br />the permit application) is for grasslands. It may be more <br />appropriate to use the mixture found on page 2 of the Maxwell <br />mine technical revision No. 1, which is designed for riparian <br />areas. The number and distribution of willow transplants, as <br />well as the seeding and mulching techniques should also be <br />discussed in the revegetation plan. <br />An additional response to Stipulation 24 which addresses the <br />above considerations should be submitted to the Division by <br />May 10. <br />The response to Stipulation 27 has been accepted. However, <br />Mike Savage of CMLRD is currently reviewing the experimental <br />design for statistical validity in order to identify any <br />potential problems before the experiment is initiated. <br />The Division is awaiting additional response to Stipulation <br />28. The response was expected in March of 1985 and is <br />currently overdue. <br />B. Stipulations to Permit Revisi <br />Stipulations 1, 3, 5, and 13 have been satisfied. <br />Stipulations 4 and 7, along with notification that the <br />monitoring wells have been completed as per stipulation 8, <br />should be submitted within 30 days of channel reconstruction. <br />Stipulations 6, 9, and 12 will be checked during field <br />inspections this season. <br />Monitoring requirements of Stipulation 2 have been changed as <br />stated within the technical revision which altered the <br />sediment pond design. However, there is no procedure included <br />for determining when the 60% sediment level is reached. An <br />annual survey is recommended for this purpose. Also, the <br />Division requires information on how water rights are being <br />protected as per Rule 2.05.6(3)(ii). <br />Stipulations 10 and 11 refer to vegetation sampling and <br />reference areas. Although there is no time frame in these <br />stipulations, it is the opinion of the Division that the <br />reference area should be established this growing season so <br />that future disturbance in the refuse area does not preclude <br />statistical comparisons. <br />
