Mr. Dave Stout - 3 - April 15, 1985
reapplication should be stated. The location and volume of
alternate material should be identified as needed, in order to
meet the reapplied topsoil depth specifications.
The seed mix proposed in the stipulation response (Volume I of
the permit application) is for grasslands. It may be more
appropriate to use the mixture found on page 2 of the Maxwell
mine technical revision No. 1, which is designed for riparian
areas. The number and distribution of willow transplants, as
well as the seeding and mulching techniques should also be
discussed in the revegetation plan.
An additional response to Stipulation 24 which addresses the
above considerations should be submitted to the Division by
May 10.
The response to Stipulation 27 has been accepted. However,
Mike Savage of CMLRD is currently reviewing the experimental
design for statistical validity in order to identify any
potential problems before the experiment is initiated.
The Division is awaiting additional response to Stipulation
28. The response was expected in March of 1985 and is
currently overdue.
B. Stipulations to Permit Revisi
Stipulations 1, 3, 5, and 13 have been satisfied.
Stipulations 4 and 7, along with notification that the
monitoring wells have been completed as per stipulation 8,
should be submitted within 30 days of channel reconstruction.
Stipulations 6, 9, and 12 will be checked during field
inspections this season.
Monitoring requirements of Stipulation 2 have been changed as
stated within the technical revision which altered the
sediment pond design. However, there is no procedure included
for determining when the 60% sediment level is reached. An
annual survey is recommended for this purpose. Also, the
Division requires information on how water rights are being
protected as per Rule 2.05.6(3)(ii).
Stipulations 10 and 11 refer to vegetation sampling and
reference areas. Although there is no time frame in these
stipulations, it is the opinion of the Division that the
reference area should be established this growing season so
that future disturbance in the refuse area does not preclude
statistical comparisons.
