No. 479 (3`' Amended) <br />July 15, 1998 <br />Page 4 <br />Approved July 24, 1973, SUP No. 22 -Condition No. 2: "The processing and <br />extraction and all other activity permitted by this special use permit shall <br />limited to day light hours" (Exhibit 4, page 5). <br />Approved January 26, 1971, SUP No. 147 -Condition No. 1: "The <br />processing shall be limited to daylight hours, as defined by official sunrise <br />and sunset as established from day to day by the US Weather Bureau at the <br />Municipal Airport or between the hours of 6 am and 6 pm, whichever provides <br />the greatest number of working hours" (Exhibit 4, page 6). <br />Approved February 26, 1974, SUP No. 147 -Condition No.1: "The processing <br />shall be limited to the daylight hours, as defined by official sunrise and sunset <br />as established from day to day by the US Weather Bureau at the Municipal <br />Airport or between the hours of 6 am and 6 pm, whichever provides the <br />greatest number of working hours" (Exhibit 4, page 7). <br />4. Section 36(f) of the Pueblo Countv Zoning Resolution establishes the findings <br />the Planning Commission must make in its approval of a special use permit. <br />Following is a list of those findings in bold face print, with staff comments <br />indented thereafter. <br />(a) The requested use is a use listed as a special permitted use in the <br />district in which the parcel is located. <br />Staff: Natural Deposit Extraction and Processing is a use listed within the A-2 <br />Zone District. <br />(b) The granting of the special use appeal will not substantially modify <br />the land use plan or the intent, purpose and spirit of this resolution. <br />Staff: This special use permit does not significantly modify the land use plan. <br />According to the Zoning Resolution, the spirit and purpose of the A-2 Zone <br />District "are designed to retain and promote the appropriate use of dry range and <br />irrigated lands and encourage open use of the land in keeping with its natural <br />characteristics and agricultural functions." <br />This special use permit is consistent with that intent. The concept of zoning <br />underlying "special Use' or "uses-by-review" is that such uses are not inherently <br />inconsistent with the "principal uses" or "uses-by-review" of the zone district. <br />However, a specific use-by-review may not be appropriate at all locations <br />throughout the zone district. Therefore, the Planning Commission is given the <br />opportunity to consider the compatibility of the use with surrounding uses. The <br />
