No. 479 (3rtl Amended) <br />July 15, 1998 <br />Page 3 <br />OTHER AGENCY COMMENTS <br />The Colorado Division of Wildlife letter of 7/10/98 indicates the proposal will not have <br />any additional significant impact in this already disturbed area. <br />The Armv Corps of Engineers fax message of 7/6/98 indicates no comments on this <br />proposal. <br />The Pueblo County Department of Public Works memo of 7/9/98 indicates no <br />comments for this land use case. <br />STAFF COMMENTS <br />Staff conducted an on-site review of the property on July 14, 1998, and observed <br />the following (Exhibit 5): The site is being mined for sand and gravel. <br />2. The applicant is seeking an amendment to the special use permit to allow <br />unlimited hours of operation for the extraction and processing activity that would <br />serve the Pueblo Dam reconstruction project. Staff discussed the expanded <br />mining activity with Mr. Mark Klune July 7, 1998. He indicated Transit Mix would <br />need additional hours of operation to be able to accommodate the large volumes <br />of material needed for the project. Staff requests the applicant prepare evidence <br />in the form of an extraction and processing capacity and capability analysis <br />report to verify that 7-day-per-week processing and extraction during daylight <br />hours OIVLY would not be sufficient for serving this project. Given that <br />stockpiling and additional processing may take place within the existing I-3 Zone <br />District without limitation as to hours, staff is not convinced the amendment is <br />absolutely necessary and would need to see additional information to confirm <br />the need. If the analysis provides sufficient evidence to the satisfaction of the <br />Planning Commission, staff could support the temporary expansion of operating <br />hours. <br />4. Staff notes that SUP 479 must comply with the previously approved conditions of <br />approval for incorporated SUP No. 22 and No. 147, for which the following <br />requirements continue to apply: <br />Approved May 28, 1965, SUP No. 22 -Condition No. 2: "The processing <br />shall be limited to the daylight hours, as defined by official sunrise and <br />sunset as established from day to day by the US Weather Bureau at the <br />Municipal Airport or between the hours of 6 am and 6 pm, whichever provides <br />the greatest number of working hours" (Exhibit 4, page 4). <br />
