Memo to P.C.P.C. • <br />Re: S.U.P. No. 479 (3rd Amended) <br />July 15, 1998 <br />Page 2 <br />included SUP No. 22, No. 36, and No. 147. Exhibit 4 is the action letter, dated October <br />29, 1996, which was sent to the applicant (at that time Valco, Inc.) after the annual <br />review. This letter identifies the full complement of conditions of approval that are still <br />in force. <br />In regard to SUP No. 479, the Pueblo County Planning Commission (PCPC} approved <br />SUP No. 479 on January 18, 1983, and again on July 24, 1984. On June 24, 1986, the <br />PCPC voted to approve an amendment to SUP No. 479 which added 11.93± acres to <br />the permit, then heard it again on 2-year reviews at the July 22, 1986, July 26, 1988, <br />July 24, 1990, April 25, 1995, and October 22, 1996 meetings. The permit was <br />approved most recently with the following conditions: <br />1. The owner and operator shall provide the Department of Planning and Development <br />with a copy of any Federal, State, or local permit applications, approvals, <br />amendments, or releases (e.g., air quality, MLRB, augmentation, access, NPDES, <br />404, etc.} pertaining to Special Use Permit No. 479 within 30 days of their submittal <br />and approval. <br />2. Map Amendment No. 96-25 shall be approved by the Board of County <br />Commissioners. <br />3. The applicant shall submit a Flood Hazard Development Permit for conducting <br />mining activities within the 100-year floodplain which alter the course of the river <br />within 90 days of authorization to alter said river course being granted by the <br />requisite Federal and State agencies with oversight. <br />4. The applicant shall file an updated Mined Land Wildlife Statemenf/Evaluation <br />reflecting the proposed reclamation for the additional acreage being received from <br />the State. Said Statement/Evaluation shall be submitted to the Department of <br />Planning and Development within sixty days of the closing and consummation of the <br />Land Exchange Contract between Valco, Inc., or their assigns or heirs, and the <br />State of Colorado or their assigns or heirs. <br />5. The applicant shall file a copy of their Annual Mined Land Reclamation Report with <br />the Department of Planning and Development at the time it is submitted to the State <br />of Colorado, Department of Natural Resources, Mined Land Reclamation Division. <br />6. Special Use Permit No. 479 (Amended) shall be placed on a five-year review (July, <br />2000) or be reviewed as the property description for the mining operation requires <br />amendment. <br />
