<br /> <br />Findings of the <br />Colorado Mined Land Reclamation Division <br />for <br />Southfield Mine <br />Explanation of Findings <br />Pursuant to Rule 2.07,6(2) of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, and the approved state program, the <br />Mined Land Reclamation Division or the Board must make specific written <br />findings prior to issuance of a permit, permit renewal or permit revision. <br />These findings are based on information made available to the Division which <br />demonstrates that the applicant will be able to operate in compliance with the <br />Colorado Surface Coal Mining Reclamation Act and the Regulations promulgated <br />pursuant to the Act. <br />The findings in the following sections required by Rule 2.07.6(2) are listed <br />in accordance with that rule. The findings and specific approvals required <br />pursuant to Rule 2.07.6 (2)(m) are listed in accordance with Rule 4 and are <br />organized under subject or discipline subtitles. <br />This is the revision Findings Document for the Southfield Mine. The following <br />findings were reevaluated and updated as necessary to reflect changes which <br />have occurred during the past permit term and to reflect changes resulting <br />from the revision. Any stipulations from the original permit and Findings <br />Document or subsequent revisions that have been completely resolved to the <br />satisfaction of the Division, have been removed from this document. <br />I. Legal, Financial and Compliance Information - Rules 2.03 and 2.07.6{2) <br />Legal, financial and compliance information is contained in Section 2.03 of <br />the Mining and Reclamation Plan (MRP). All violations issued to EFCI have <br />been abated and terminated. <br />The original Findings Document contained a stipulation (N o. 1) requiring <br />right-of-entry information for Florence, Massey and Corley properties, prior <br />to affecting those lands. This information was submitted with adequacy <br />responses on October 31, 1989 during permit renewal. <br />All other information required by Rule 2.03 is included in the MRP except for <br />right-of-entry information for the Slanovich property within the proposed <br />permit area expansion. Therefore, the following stipulation is required: <br />STIPULATION N0. 12 <br />PRIOR TO AFFECTING THE LAND IN THE SOUTHWEST 1/4 SECTION 23, TOWNSHIP <br />20 SOUTH, RANGE 70 WEST, THE OPERATOR SHALL SUBMIT RIGHT OF ENTRY <br />INFORMATION FROM THE OWNER. <br />In accordance with Rule 2.07 ,6(2)(a), (f), (g) and (h ), the Division finds <br />that the operator has submitted a complete application and that the operator <br />does not control mining operations with a demonstrated pattern of willful <br />violations. <br />With acceptance of the above stipulation, the operation is in compliance with <br />the requirements of this section. <br />-7- <br />
