<br />II. Land Use - Rules 2.04.3, 2.05.5, and 4.16 <br />Pre- and post-mine land use information for the mine and load-out is contained <br />in Section 2.04.3 of the MRP. Rangeland/wildlife habitat constitutes the <br />pre-mining land use for the mine site and load-out permit area. This land use <br />has not been changed in the five year period preceeding mining. Pursuant to <br />Rule 2.07.6(2)(1) the Division approves the proposed post-minng land use of <br />rangeland/wildlife habitat for the mine and for the load-out. <br />The operation is in compliance with the requirements of this section. <br />III. Cultural and Historic Resources - Rules 2.04.4 and 2.05.6(4) <br />Information pertaining to cultural and historic resources is contained in <br />Section 2.04.4 and Exhibit 6 of the MRP. A search of the Colorado Inventory <br />of Cultural Resources conducted by the Office of Archaeology and Historic <br />Preservation, Colorado Historical Society, found no sites or structures listed <br />on or known to be eligible for the National Register of Historic Places within <br />the proposed expansion area. The same results were found by an earlier search <br />of the existing permit area. The Division finds that the mining operation <br />will not adversely affect any place listed, or eligible for listing on the <br />National Register of Historic Places or publicly owned park in accordance with <br />Rule 2.07.6(2)(e). <br />The operation is in compliance with the requirements of this section. <br />IV. Geology - Rules 2.04.5 and 2.04.6 <br />Sections 2.04.5 and 2.04.6 of the MRP contain geologic information for the <br />proposed permit area expansion. Coal to be mined in these areas is from the <br />same two seams as have been mined in the past by EFCI. Geologic information <br />in the MRP includes geologic maps and cross-sections, geologic logs, chemical <br />and physical analyses of roof and floor material and coal analyses. <br />The proposed permit area expansion lies within the same geologic basin as the <br />existing permit area. The coal seams to be mined and the surrounding strata <br />are essentially continuations of the previously mined area. <br />The operation is in compliance with the requirements of this section. <br />V. Iydrologic Balance - Rules 2.04.5, 2.04.7, 2.05.3, 2.05.6(3) and 4.05 <br />Groundwater <br />Groundwater information is contained in Sections 2.04.7, 2.05.6 and 4.05 <br />of the MRP. Baseline information is included, as well as results and <br />evaluation of groundwater monitoring performed during the previous permit <br />term. The groundwater monitoring plan is summarized in Exhibit 25 and on <br />pages 2.05.6-51 through 54. No changes in the groundwater monitoring <br />plan are proposed in the permit revision. The groundwater monitoring <br />program consists of quarterly monitoring of five wells which are <br />completed in each of the two coal seams being mined by Southfield. Water <br />levels and relevant chemical parameters are monitored and results are <br />reported in the mine's annual hydrologic report. <br />-$- <br />
