In order to provide sufficient verification of the revised swell factor„ <br />Peabody has committed in the permit application (Volume 9, Tab 12, p. 12-46) <br />to evaluate the swell factor based on actual conditions at the mine site. The <br />first cut at Mining Area No. 1 will be evaluated. Upon completion of the <br />evaluation, Peabody will submit a report to the Division in July of 1987. <br />Thereafter, an annual post-mining topography map will be submitted to the <br />Division. If Peabody finds in its annual monitoring of grading and field <br />conditions that the post-mining topography will deviate significantly and <br />adversely from that shown on the map, the Division will be notified and <br />appropriate modifications will be made to tfie permit. <br />The original approval document of April, 1983 had as Stipulation No. 1 the <br />requirement for Peabody to annually submit a post-mining topography map. <br />Since Peabody has committed to doing this within the Permit Revision No. 1 <br />application, the Division deems that this stipulation is no longer required. <br />The operation is in compliance with the requirements of this section. <br />XVIII. Coal Processing Waste and Non-Coal Processing Waste -Rules <br />a <br />Information pertaining to processing waste is presented in Volume 9, Tab 12. <br />There are no coal processing facilities at this site since the coal is hauled <br />directly to the Nucla Generating Station. Therefore, the requirements of this <br />section are not applicable. <br />The original solid waste disposal site was backfilled and partially graded as <br />part of the temporary cessation activities in 1983/1984. Final reclamation of <br />this area will occur when mining activities in Mine Area 4 are finished. With <br />the closure of this on site facility all non-coal processing waste will <br />periodically be transported to the Montrose and San Miguel County landfill. <br />This landfill is located just north of the Nucla Mine. <br />The operation is in compliance with the requirements of this section. <br />XIX. Mine Facilities, Coal Handling Structures, Support Facilities - Rules <br />3-7-e--~-rsr~s~-~~sr~.,a ,,~ <br />Information pertaining to mine and support facilities is presented in Volume <br />9, Tab 12. There are no coal handling structures at this mine. <br />The operation is in compliance with the requirements of this section. <br />XX. Roads - Rules 2.05.3(3) and 4.03 <br />Information pertaining to roads at the Nucla Mine is presented in Volume 9, <br />Tab 12. This permit application tab discusses location, design and <br />construction, drainage, surfacing, maintenance and reclamation for haul, <br />access, and light-use roads. <br />-28- <br />
