~~ <br />-3- <br />I. Decision to Require Revision <br /> <br />The Division has conducted a mid-term review under Rules 2.08.3, 2.06.2(a), <br />2.06.3(4), 2.06.5(3), 2.06.7(5) and 3.02.2(4). The review included the Hayden <br />Gulch permit application, all subsequent revisions, all stipulation responses, <br />hydrologic monitoring data, past inspection reports, and on-site inspections. <br />The Division finds that certain revisions and modifications are needed to <br />insure future compliance with the Colorado Surface Coal Mining Reclamation Act <br />and the Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining. The following section details the revisions required, justification <br />for requiring the revisions and timetable for submitting the revisions. <br />Section IA responses should be submitted as one package by February 1, 1985. <br />After obtaining the CMLRD permit (number C-003-80) on H-G Coal Company <br />continued operations in their existing Pit until November 4, 1983, when the <br />Hayden Gulch Mine went into temporary cessation of operations due to economic <br />conditions. The permittee commenced operations again on or about April 2, <br />1984. At this time the mine had submitted a permit revision to amend the mine <br />plan, decreasing production and the life of mine. This permit revision was <br />approved, and H-G coal is now operating in accordance with the amended permit. <br />IA. Revisions Requires <br />1. Legal, Financial, Compliance Information - The Division finds that <br />the following information and needs to be updated to reflect changes <br />that have occurred over the past 2 1/2 years. Specifically: <br />a. H-G Coal needs to update the compliance information contained <br />in the Hayden Gulch permit. <br />;.,as4~ <br />b. The washwater discharge permit issued by the Colo Dept. of <br />~~ Health expired on June 30, 1984. H-G needs to provide MLRD with a <br />copy of the new permit. <br />c. The Open Burning Permit (# 1920-OB-017) expired on <br />,~~ January 1, 1982. H-G needs to provide the Division with a copy of <br />the renewed permit. <br />d. The NPDES permit for the sanitary waste water lagoon (# CO <br />djL 36447) expired on June 30, 1984. H-G needs to provide the Division <br />with a copy of the renewed permit. <br />e. H-G Coal needs to revise and update all copies of their permit <br />? application on file with the Division to reflect all submittals <br />received by the Division after permit issuance; including but not <br />limited to responses to stipulations and revisions required by this <br />2 1/2 year review. <br />All material should be noted as revised and dated and incorporated by <br />H-G Coal into the permit application document. <br />
