<br />-4- <br /> <br />2. Hydrologic Balance: Ground and Surface Water <br />a. The permittee has not been submitting ground and surface water <br />monitoring data as required. Therefore, the Division has not <br />been able to assess whether any unpredicted impacts have <br />occurred at the mine. Specifically, H-G needs to submit the <br />following information collected to date, and maintain the <br />submittal frequencies noted: <br />~/ 1. Sediment pond quarterly self inspections for the third <br />quarter of 1984; and on a quarterly basis thereafter. <br /> 2. Water monitoring reports for the surface water monitoring <br />r ~ program from 1981 to date in accordance with 2.05.6 <br />n <br />~ll'z <br />` (3)(.6)(iii) of the permit application, to be submitted <br />r <br />/ <br />~ emi-annually. <br />s <br /> l! <br />t/j. Sediment level surveys of all sediment ponds from 1982 to <br />date, in accordance with 2.05.3(4) Appendix E of the permit <br />application, to be submitted annually after survey by a P.E. <br />~~ s <br />H-G has requested that all sediment ponds be retained as stack <br />ponds after mining. The Division is required to make a finding <br />regarding the designs of the structures and the appropriateness <br />of retaining them to serve the post-mining land use. Prior to <br />the Division approving the retention of the ponds, H-G needs to <br />submit all information required by Rule 4.05.9 regarding the <br />retention of the ponds. <br />~! H-G needs to submit any final decisions or actions regarding <br />their application for water rights for water retained in the <br />sediment ponds at the mine and load-out. <br />/H. Within the application H-G has provided a number of certified <br /> renderings of the sediment ponds. As in the case of the haul <br /> roads earlier this year, the Division needs to be assured that <br /> all ponds have been constructed as approved per the designs in <br />_ <br />drt the permit. If the renderings represent "as built" <br />_~. <br />~`'S configurations of the ponds, a letter from your Professional <br />~„s° Engineer to that effect would suffice to satisfy the Division <br />N'"~ <br />F <br />(please see Attachment I). If this is not the case, H-G will <br />~~'~` need to provide a certification consistent with the <br /> requirements of the Division (see July 13, 1984, Policy Memo <br /> from the Division). <br />3.
