Long, Division Director <br />Division of Minerals and Geology <br />Department of Natural Resources <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 <br />Re: Reclamation of the Burlington Northern Railroad Loadout <br />Lease Area, Energy Fuels Mining Company, <br />Raton Creek Mine, Permit No. C-82-055 <br />Dear Mr. Long: <br />The City of Trinidad is the owner of certain property which it <br />acquired from Burlington Northern Railroad, and which was <br />previously leased by Energy Fuels Mining Company. Sometime <br />prior to the acquisition by the City, Energy Fuels used the <br />property for a coal loading operation. The City acquired the <br />land from Burlington Northern for future use as a disposal site <br />for wastewater sludge. At the time of acquisition, the City had <br />no knowledge of the prior use by Energy Fuels. <br />Only recently the City has been informed that your Division is <br />requiring Energy Fuels to perform reclamation work at the site. <br />Previously, we were contacted by Energy Fuels concerning its <br />efforts to have its reclamation bond released. It has only been <br />in the last week that the City has actually been contacted by <br />the Division of Minerals and Geology. Our Utilities <br />Superintendent, James Fernandez has been contacted by telephone <br />and letter from Wallace H. Erickson, Environmental Protection <br />Intern. A copy of his letter dated November 3, 1993 is <br />enclosed. <br />Uur immediate desire <br />between the Division <br />is to open up the lines of communication <br />and the City on <br />concern to the City is the impact of <br />City"s desire to use the property as <br />is our understanding that the purpose <br />the property back into the condition <br />operation began.
