<br />E. The Division proposes to approve of the reference aeeas which the applicant has <br />selected based on the requirements of Rule 4.15.7(3). <br />F. The reference areas will be utilized to determine revegetation success in a manner <br />which the Division finds acceptable.4.15.7(4)) <br />XII. Post-mining Land Use <br />No specific approvals are granted under this section. <br />XIII. Protection of Fish, Wildlife and Related Environmental Values <br />A. Fish and wildlife habitat is a planned post-mining land use. The applicant has not <br />presented a plan which satisfactorily addresses concerns for the establishment of <br />shrubs on the reclaimed aeeas of the surface mine. Therefore, the following <br />stipulation is attached to the permit. (4.18(5)(n) <br />STIP #11 <br />LORENCITO COAL COMPANY WILL SUBMIT A TECHNICAL REVISION <br />TO THE PERMIT BY FEBRUARY 15, 1998 TO INCORPORATE A PLAN TO <br />ESTABLISH SHRUBS ON THE RECLAIMED PORTIONS OF THE SURFACE <br />MINE. THIS PLAN WII.L ADDRESS THOSE ISSUES AS DEFINED BY THE <br />DNISION OF WILDLIFE, AS OUTLINED IN THEIR ADEQUACY LETTERS <br />AND/OR ADEQUACY QUESTIONS 111, 190, AND 191 OF THE INITIAL <br />DNISION ADEQUACY REVIEW, LLC RESPONSES, OR ANY <br />SUBSEQUENT REVIEW AS DOCUMENTED. <br />XIV. Protection of Underground Mining <br />A. The Division does not approve surface coal mining activities being conducted <br />within 500 feet of an active or abandoned underground mine. The applicant has <br />not provided the Division with the appropriate documentation demonstrating that <br />approval for surface coal mining activities within S00 feet of an active underground <br />mine has been granted by MSHA and Colorado Division of Mines, and that <br />improved resource recovery, abatement of water pollution, and elimination of <br />hazards will result.
