THOSE ADEQUACY ISSUES <br />IDENTIFIED BY QUESTIONS 114 AND 200 OF THE DIVISION'S <br />ADEQUACY REVIEW HAVE BEEN APPROVED THROUGH A MINOR <br />REVISION TO THE PERMIT. <br />XV. Subsidence Control <br />A. The applicant has proposed a subsidence control plan in accordance with Rule <br />2.05.6(6) and has committed to adopt all measures in order to reduce the likelihood <br />of subsidence, prevent material damage, or mitigate the effects. The applicant will <br />control subsidence be leaving adequate coal in place, thus preventing subsidence. <br />Pillar mining techniques will be used with no secondary retreat mining. The <br />Division proposes to approve the plan.(4.20.1(2) and 4.20.3(1)) <br />B. The applicant has proposed a subsidence monitoring program, in accordance with <br />Rule 2.05.6(6)(c), designed to determine the commencement and magnitude of <br />subsidence movements. Map 2.05.6-1 depicts the location of monuments to be <br />installed and structures to be monitored within the permit and adjacent azea. The <br />results of the monitoring program will be submitted to the Division semi-annually. <br />The monitoring program is designed to extend for a time, beyond cessation of <br />mining in any area, consistent with the need for verification of the subsidence <br />prediction. <br />XVI. Concurrent Surface and Underground Mining <br />No specific approvals have been granted under this section (4.22.2). <br />XVII. Operations on Alluvial Valley Floors <br />A. The Division has determined that an alluvial valley floor exists within the affected <br />or adjacent area. Therefore, the following findings aze in order for'the portion of <br />the alluvial valley floor known as Purgatoire River AVF located at the mouth of <br />I,orencito Canyon and flood irrigated by the Chacon ditch. <br />The Division finds that activities proposed by the applicant will not interrupt, <br />discontinue, or preclude farming on the alluvial valley floors that are irrigated or <br />naturally subirrigated. Although the rail spur will bisect the irrigated Chacon <br />pasture, a feeder ditch will be constructed adjacent to the rail spur to allow <br />irrigation of all available azeas not occupied by the rail spur itself. Approximately <br />1.1 acres of the pasture will be occupied by the rail spur itself. This small area is <br />2% of the 53 acres of irrigated pastureland and provides negligible support for the <br />ongoing ranching operation. (4.24.3(1)). <br />32 <br />
