The Division proposes to approve the use of vegetation and organic material as <br />mulch or as an amendment to topsoil to control erosion, promote growth, or <br />increase moisture retention. (4.09.1(4)) <br />E. The Division conditionally approves of the location of the disposal azeas, assuming <br />that Stipulations # 7 and # 8 have been complied with. (4.09.1(6)) <br />F. The Division proposes to approve the use of terraces in order to conserve soil <br />moisture, control erosion, and enhance stability. They are compatible with the <br />post-mining land use of rangeland and wildlife habitat. The width of these terraces <br />shall not exceed 20 feet and the vertical distance between terraces will be 40 feet. <br />Culverts or underground rock drains are not approved on the terraces. (4.09.1(9)) <br />and 4.14.2(2) <br />G. The applicant has not proposed to dispose of excess spoil in underground mine <br />workings. (4.09.1(15)) <br />VIII. Coal Mine Waste Banks <br />A. The Division is proposing to approve plans for use, construction and maintenance <br />of a coal mine waste disposal area. The applicant plans to transport coal produced <br />at the Lorencito Canyon mine to the New Elk mine site, where it will be processed <br />and the waste product will be transported by conveyor to the existing refuse <br />disposal azea at the New Elk mine. However, the applicant has not demonstrated <br />that the waste produced from the processing of the Lorencito coal product will have <br />the same composition qualities as the previous material used to analyze the stability <br />of the waste pile. Therefore, the following stipulation to the permit is necessary. <br />(4.10.1 (1)) <br />STIP #9 <br />NO COAL MINE WASTE GENERATED FROM COAL MINED AT THE <br />LORENCITO MINE MAY BE DISPOSED OF IN THE NEW ELK REFUSE <br />DISPOSAL AREA PRIOR TO FINAL APPROVAL OF A TECHNICAL <br />REVISION TO THE NEW ELK PERMIT (#C-81-012) DEMONSTRATING <br />THAT SUCH WASTE CAN BE DISPOSED OF IN THE NEW ELK REFUSE <br />PILE WITHOUT JEOPARDIZING PAST, PRESENT, OR FUTURE STAB)LITY <br />AND ALL APPLICABLE RULES AND REQUIl2EMENTS FOR COAL WASTE <br />DISPOSAL AREAS WII.L BE MET. THIS REVISION WII.L ADDRESS ANY <br />AND ALL ISSUES AS IDENTTFIIED IN QUESTION ]02 OF THE DNISION'S <br />INITIAL ADEQUACY REVIEW (DATED MARCH 3, 1997), LLC RESPONSES, <br />OR ANY SUBSEQUENT REVIEW AS DOCUMENTED. <br />B. The applicant has not submitted a plan for disposal, at the approved disposal area <br />within the permit boundary, of mine waste materials generated by activities outside <br />the permit boundary.
