The disposal area will be inspected on a regular basis by a qualified professional <br />specialist under the direction of the professional engineer, experienced in <br />construction of similaz earth and waste structures. Inspection by this person has <br />been approved by the Division as appropriate. (4.10.2(1)) <br />D. An alternative subdrainage system for the coal mine waste area has been proposed. <br />The Division finds that such an altemative will ensure the applicable static safety <br />factor, stability of the fill, and protection of the surface and ground water. <br />(4.10.3(5)) <br />E. The Division is proposing not to approve a variation in the requirements for <br />maximum allowable lift thickness and minimum required compaction. <br />(4.10.4(3)(a)) <br />F. The applicant has not submitted a demonstration based on physical and chemical <br />analyses that shows that revegetation requirements of 4.15 can be met with less <br />than 4 feet of cover on the coal processing waste bank. (4.10.4(5)) <br />IX. Coal Mine Waste <br />A. The applicant has proposed to dispose of underground development waste in <br />underground mine workings. This plan has not been approved by MSHA and the <br />Division and therefore, a stipulation to the permit is necessary. (4.11.3) <br />STIP 1r 10 <br />BY NOVEMBER 1, 1997, LORENCITO COAL COMPANY WILL SUBMIT A <br />TECHNICAL REVISION TO THE PERMIT INCORPORATING A PLAN TO <br />DISPOSE OF UNDERGROUND MINE DEVELOPMENT WASTE IN <br />ABANDONED WORKINGS. THIS REVISION WII,L ADDRESS ANY AND <br />ALL ISSUES AS IDENTIFIED IN QUESTION 72 OF THE DNISIONS INITIAL <br />ADEQUACY REVIEW AND AS REQUII2ED BY RULE 2.05.3(9). THIS <br />SHALL INCLUDE A PLAN FOR EXTINGUISHING FIRES IN THE COAL <br />MINE WASTE AS REQUII2ED BY RULE 4.1 l.l. NO COAL MINE WASTE <br />MAY BE DISPOSED OF IN ABANDONED WORKINGS PRIOR TO <br />RECENING FINAL DNISION APPROVAL OF THE REVISION. <br />B. The Division has not reviewed and approved of a plan for extinguishing coal mine <br />waste fires. Therefore, the stipulation #10, as noted in D{. A above, has been <br />attached to the permit. (4.11.1) <br />C. The Division does not approve a plan for removal of burned waste. (4.11.2 and <br />4.11.3) <br />za <br />
