<br />THE STORM AND THE POND ELEVATION NECESSARY TO CONTAIN THIS RUNOFF WITHOUT <br />DISCHARGING THROUGH THE EMERGENCY SPILLWAY. SEDIMENT INFLOW NEEDS TO BE <br />CONSIDERED IN THIS CALCULATION. <br />Status: Resolved (December 20, 1984). CYCC submitted a plan to dewater the <br />Mine No. 3 and Middle Creek detention basins utilizing a pump <br />system. CYCC subsequently proposed installing a primary dewatering <br />device in each pond as part of Technical Revision No. 1 (September <br />16, 1986). <br />STIPULATION N0. 9 <br />THE PERMITTEE MUST SUBMIT TO THE DIVISION, TO BE INCORPORATED INTO THE PERMIT <br />APPLICATION, A PLAN FOR POND MAINTENANCE AND CLEAN OUT SO THAT THE POND WILL <br />HAVE ADEQUATE VOLUME FOR STORAGE OF THE 10 YEAR - 24 HOUR STORM. THIS <br />INFORMATION MUST BE SUBMITTED 30 DAYS OF PERMIT ISSUANCE. <br />Status: Resolved (December 20, 1984). CYCC submitted a pond maintenance <br />plan that included quarterly embankment inspections. Annual <br />inspections would determine if vegetation cutting or other <br />maintenance would be required. The ponds are to be cleaned when <br />sediment in the pond reaches 60% of design capacity. <br />STIPULATION N0. 10 <br />BECAUSE THE RETENTION OF WATER IN THE DETENTION BASINS WILL EXCEED 2 AC-FT, <br />THE PERMITTEE MUST CONTACT THE STATE WATER COURT TO FILE AN AUGMENTATION PLAN <br />SHOULD THIS WATER BE NEEDED. THE PERMITTEE SHALL PROVIDE THE DIVISION WITH A <br />COPY OF THE SUBMITTED AUGMENTATION PLAN WITHIN 60 DAYS OF PERMIT ISSUANCE. <br />Status: Resolved (March 25, 1985). <br />STIPULATION N0. 11 <br />WITHIN 60 DAYS OF THE ISSUANCE, THE PERMITTEE MUST SUBMIT TO THE DIVISION, TO <br />BE INCORPORATED INTO THE PERMIT DOCUMENT, A PLAN FOR RECLAMATION OF THE ENERGY <br />MINE N0. 3 AND MIDDLE CREEK DETENTION BASINS OR A PLAN FOR PERMANENT <br />STRUCTURES PER RULE 4.05.9. <br />Status: Resolved (February 2, 1987). CYCC submitted a response regarding <br />pond reclamation and the Division requested additional information <br />in April, 1985.
