2.05.2(1) Production <br />Incompliance by exception. There is no current or planned production at the site. <br />2.05.2(2) Operation <br />Incompliance by exception. Operations are limited to permit area reclamation. See the <br />following paragraph. <br />Rule 2.05.3 Operations Plan -Permit Area <br />2.05.3(1) Production <br />In compliance by exception. During active surface coal extraction, the number 7 seam of the <br />Laramie formation was mined (Application, Sec 2.04.5, para 3, page 41). Currently, there is no <br />coal extraction activity at the site and none is anticipated (Sec 2.03.8, page 29, 5/96). <br />2.05.3(2) Operation <br />[n compliance (Permit, page 102 through 109). Maintenance of facilities, flyash disposal, and <br />reclamation activities are described. Recommended updating of a statement on page 103 of the <br />Permit is as a result of this review (see Paragraph 4 below). <br />2.05.3(3) Facilities <br />Incompliance. Facilities aze described. See pages 102 and 103 and referenced sections of the <br />Permit. Roads, perimeter drainage ditches, buildings, the sewage treatment plant, and like <br />support facilities are described. <br />2.05.3(4) Ponds and Diversions <br />Incompliance. Sedimentation Pond 2 is still in use. It is a permanent feature, as is a dug-out <br />pond. Perimeter ditches on the north boundary of the Permit are also permanent features. See <br />page 105 of the Permit. <br />2.05.3(5) Topsoil <br />Incompliance. The only operation is replacement of stockpiled topsoil as reclamation activities <br />proceed (Permit, page 114). <br />2.05.3(6) Overburden <br />Incompliance. Stored spoil is placed over flyash as the pits are reclaimed. (Permit, pages 113 <br />and 114) <br />14 7 Septembez 1999 <br />
