2.05.3(7) Coal Handling Structures <br />fn compliance by exception. All coal-handling structures have been demolished. <br />2.05.3(8) Wastes <br />[n compliance by exception. There is no coal mine waste at the site. Non-coal processing wastes <br />are buried during backfill of the pits (Permit, page 104). <br />2.05.3(9) Waste Disposal <br />Incompliance by exception. There is no return of coalmine waste to abandoned workings. <br />Rule 2.05.4 Reclamation Plan <br />2.05.4(1) The Plan <br />Incompliance (Permit, pages 113 through117). Of the 822.37 acres in the Permit area, 413 acres <br />were disturbed. The Keenesburg Mine was a surface mine, thus Affected acreage equals <br />Disturbed acreage at 413 acres. Of the 413 disturbed acres, 194.4 acres have been reclaimed and <br />revegetated (AHR, 1998, page 124). In its 1996 Bond Release Application, CEC applied for <br />Phase I and II release of 111.5 acres of 179.6 reported as vegetated. <br />The mine is in a state of reclamation. There aze no coal processing wastes or mine development <br />wastes on site, nor will any be generated by current or anticipated activities. Backfill of flyash <br />and spoil is complete in Pit A, and topsand is being placed. Pit B is being backfilled with flyash <br />imported from the Trigen-Colorado L.L.L.P. power plant in Golden (and a small quantity of <br />hard-rock mine waste), and reclaimed in accordance with the reclamation plan described in the <br />Permit. Flyash is placed five (5) feet above the re-established local ground water table, covered <br />by six feet of spoil and two feet of topsoil (topsand), and revegetated (Permit, Sec 2.05.4). <br />There will be some non-coal wastes generated by demolition of facilities. These wastes are to be <br />placed in the pits between the limits of five (5) feet above the local ground water table and four <br />(4) feet below Approximate Original Contour (AOC). (Application, 2.05.4, page 113, line 41- <br />42). All facilities at the site are currently scheduled for removal, with the exception of electrical <br />lines not owned by CEC, Sedimentation Pond 2 with perimeter collection ditches, and a dueout <br />pond. The facilities to be removed include the office, shop and warehouse; equipment parking <br />lot; sewage treatment facility; all roads; electrical distribution system (to the extent owned by <br />CEC); potable water system; explosive storage facilities, and monitoring wells. (Sec 2.05.3, page <br />106). <br />Pit backfill will eliminate highwalls (Final Contour and Drainage Plan). <br />A part of Section 2.05.3, on revised page 103, 2nd and 3`d lines, is outdated. That part that <br />currently reads "A-pit is presently being used for ash disposal." Might be change to read: <br />]5 ~ 7 September 1999 <br />
