Summary
The Review Process
In accordance with Rule 2.08.5, the Division notified Eastside, on 1 Mazch 2004, of the need to
renew the existing permit_ The permit renewal application (application dated 15 7uly 2004, was
received by the Division on 19 July 2004. The application was deemed complete on 30 July
2004. Notice of the permit renewal application was published by Eastside in the Glenwood Post
on 14, 21, 28 October and 4 November 2004. A copy of the application was placed on file for
public review at the Garfield County Courthouse (Courthouse). The Division notified selected
agencies of the application by letters on 30 July 2004. An adequacy letter was sent to Eastside on
30 September 2004. These adequacy items were satisfactorily resolved under an Eastside
response of 15 November 2004.
Permit History
On 14 3anuary 1985, the Division issued mining and reclamation permit number C-84-063 to the
Eastside Coal Company, Inc. (Eastside) for operation of the Eastside Mine. The decision was
based on written Findings of Compliance published on 14 December 1984. The permit was
renewed in 1990, and again in 1995. The mine was in intermittent operation, with a number of
