Introduction <br />The Division of Minerals and Geology (Division) received an application from the Eastside Coal <br />Company, Inc. (Eastside), for the fourth renewal of Permit C-84-063 to conduct coal mining <br />reclamation activities at the Eastside Mine (application). This document is the decision package <br />prepared by the Colorado Division of Minerals and Geology (Division) on the application. This <br />document includes: 1) the proposed decision to approve the application for renewal; 2) a <br />summary which includes a history of the review of the application, a description of changes made <br />to the permit under this renewal action, a description of the environment affected by the <br />operation and a description of the mining and reclamation plan; and 3) the written findings of <br />compliance the Division has made as required by the Colorado Surface Coal Mining Reclamation <br />Act and the Regulations of the Colorado Mined Land Reclamation Boazd for Coal Mining. The <br />Regulations of the Colorado Mined Land Reclamation Boazd for Coal Mining (Rules) contain the <br />complete text of rules referenced throughout this Findings of Compliance document. <br />The Eastside Mine is in permanent cessation. No coal production is proposed during the pertnit <br />renewal period. The mine was reclaimed in 1995. Eastside is proposing reclamation maintenance <br />work and monitoring activities during this permit term. <br />The mine is located on private lands within Garfield County. The legal description of the lands <br />included within the permit area is: <br />Section 24, TSS, R92W, 6'~' P.M., Garfield County, Colorado, more specifically described as follows: <br />Commencing at a point which beazs S6°25'08"W, 483' +/- from the NE corner of Section 24, thence <br />south a distance of 905' +/-; thence S89°27'34"E a distance of 2650' +/-; thence south a distance of <br />975' +/-; thence west a distance of 4160' +/-; thence NS°23'22"E a distance of 2662' +/-; thence <br />S80°04'26"E a distance of 2030' +/- to the point of beginning. <br />The Eastside Mine is located in the Harvey Gap Drainage, approximately 3 '/z miles north of Silt, <br />Colorado, and approximately 1500 feet downstream from the Grass Valley Reservoir. The site of <br />the reclaimed portals and surface facilities is located on the east side of the Harvey Gap <br />Drainage_ onnosit~C9unty_Road237. The_azea9f_the~ernit.is.on_L1SCrS 7.5-minute topographic <br />map Silt quadrangle. <br />Proposed Decision <br />The Division proposes to approve the renewal application for the valid, existing Permit C-84-063 <br />for a period of five yeazs, beginning on January 13, 2005, and expiring on January 13, 2010. This <br />proposed decision approves the continuation of current, previously approved reclamation <br />activities of the Permit for the ensuing permit term. This proposed decision to approve the <br />application is based on a finding that the operations will comply with all requirements of the <br />Colorado State Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. <br />34-33-101 et seq., and the Regulations promulgated pursuant to the Act. If no request for a <br />formal hearing is made within thirty (30) days of the first publication of the issuance of this <br />proposed decision, then this decision becomes fmal. The permit application, all supporting <br />documentation and any stipulations or conditions will become a binding part of the permit. <br />Permit Renewal No. 4 1 12/03/04 <br />
