<br />Memo to P.C.P.C. <br />Re: S.U.P. No. 479 (Amended) <br />October 16, 1996 <br />Page 4 <br />Vala~ has submitted a supplement to their long-term mining plans which <br />identifies the property being received from the State as Stages 12 and 13 of <br />the mining phases for SUP 479 (Exhibit 8). <br />2. Valco and the State of Colorado have completed a lengthy negotiation which will <br />allow land to be exchanged between them. The contract includes future plans for <br />land conveyances from Valco to the State when mining operations are completed, <br />and a proposed course change for the Arkansas River to place the river course <br />adjacent to the nature trail system. <br />The initial steps in the contract call for the State of Colorado to receive 30t acres <br />from Valco and Valco to receive 80t acres from the State. The lands received by <br />the State will be rezoned to accommodate public recreation uses. The lands <br />received by Valco will be rezoned to accommodate continued mineral extraction <br />activities. <br />Subsequent steps in the contract will convey additional lands to the State by <br />Valco. The acreage involved will depend upon Valco obtaining authorizations for <br />the proposed mining plan which will alter the channel of the Arkansas to run along <br />the northern edge of the 80 acre property being received by Valco under the <br />current step. Upon completion of the mining activity, the acreage would be <br />reclaimed and, along with un-mined lands left by Valco as a buffer, be conveyed <br />to the State as an addition to the existing trail/open space system. <br />3. The applicant should be aware that a Flood Hazard Development Permit would be <br />required for mining activities being conducted in the newly added property such <br />that the course of the river would be altered. Applications are available at the <br />Department of Planning and Development. <br />RECOMMENDATIONS <br />Staff recommends APPROVAL of Special Use Permit No. 479 (Amended) with the <br />following conditions: <br />The owner and operator shall provide the Department of Planning and Development <br />with a copy of any Federal, State, or local permit applications, approvals, <br />amendments, or releases (e.g., air quality, MLRB, augmentation, access, NPDES, <br />404, etc.) pertaining to Special Use Permit No. 479 within 30 days of their submittal <br />and approval. <br />
