No. 479 (Amended) <br />October 16, 1E)96 <br />Page 2 <br />BACKGROUND <br />The Valco-owned property has been within the permitted boundary for sand and gravel <br />mining under several different special use permits which were subsequently <br />incorporated into Special Use Permit No. 479. The Pueblo County Planning <br />Commission (PCPC) approved SUP No. 479 on January 18, 1983, and again on July <br />24, 1984. On June 24, 1986, the PCPC voted to approve an amendment to SUP No. <br />479 which added 11.931 acres to the permit, then heard it again on 2-year reviews at <br />the July 22, 1986, July 26, 1988, and July 16, 1990 meetings. At the five-year review, <br />held April 25, 1995, the permit was approved with the following conditions: <br />The applicant shall provide the Department of Planning and Development <br />with a copy of any future MLRB applications, permits, or amendments within <br />30 days of their submittal to or approval by MLRB. <br />2. The applicant shall provide the Department of Planning and Development <br />with a copy of any further state or federal permit applications (i.e., access, <br />NPDES, 404, etc.) and approval thereof within 30 days of said application or <br />approval. <br />3. Special Use Permit No. 479 (Amended) shall be placed on a five-year <br />review (July, 2000) or be reviewed as the property description for the mining <br />operation requires amendment. <br />The State-owned property appears to have originally been a portion of the Honor Farm <br />complex and the Donley Dairy Farm. It has been a public use zone district since the <br />adoption of the Zoning Resolution in 1963. <br />LAND USE AND ZONING <br />The 80-acre property being received by Valco is generally cleared, vacant land with few <br />trees and appears to have been in agricultural production some years ago. The <br />continuation of the Nature Center Trail running westerly towards Pueblo Dam is the <br />northern boundary of this 80-acre property. The property is currently zoned S-1, Public <br />Use Zone District {Exhibit 4). <br />The 30-acre property being received by the State begins at the Nature Center and runs <br />generally westward along the Arkansas River and then along the existing gravel road <br />and nature trail (formerly the right-of-way for the Pueblo and Arkansas Valley Railroad). <br />The property is wooded and has not been subjected to mining activity.
