SECTION I -HISTORY <br />The Pittsburg and Midway Coal Mining Company (P&M) received a permanent <br />program permit to conduct surface coal mining operations at the Edna Mine on <br />November 16, 1981. P&M delivered its Application for Permit Renewal on <br />May 15, T986 pursuant to Rule 2.08.5 of the Colorado Surface Mining <br />Regulations. The Division issued a Proposed Decision and Findings of <br />Compliance dated January 14, 1987 recommending approval of the application <br />subject to eight stipulations. P8M objected to the Division's decision on <br />May 22, 1987. The objection was based on the inclusion of several <br />stipulations on the approval. A settlement agreement was signed by P&M and <br />the Division on November 19, 1987. This agreement resolved P&M's objection to <br />the stipulations. A mining permit was granted on January 7, 1988 subject to <br />stipulations No. 1, No. lc and No. 3 after P&M submitted a performance bond <br />rider in the amount of E7 ,121 ,196. The new permit document erroneously <br />reflected a permit expiration date of January 7, 1993. However, Division <br />policy dictates that expiration dates remain the same as the originally issued <br />Colorado State permit. Replacement permit pages with the correct dates have <br />been included with this mid-term review document. <br />Since the issuance of the permit, P&M has continued to mine in the West Ridge <br />area. Depletion of the coal resource in this area is expected to occur in <br />T990. Once this occurs coal production will shift to the Moffat area. This <br />area is in the northern portion of the Edna Mine Permit laying along the <br />western flank of a ridge which separates Oak and Trout Creeks. The Moffat <br />area contains approximately 9 million tons of coal reserves. Approximately <br />6 million tons of coal is recoverable. A twenty year mining life is estimated <br />for the Moffat area. <br />In the fall of 1989 P&M conducted a drilling program consisting of <br />twenty seven holes in the Moffat area of the mine permit area. The primary <br />purpose of this drilling program was to gather coal quality information on the <br />Wadge Seam. The drill hole pattern was designed to provide lithologic data <br />for the proposed Moffat sedimentation pond. No drilling was performed within <br />a 200 foot buffer zone paralleling Trout Creek. <br />-2- <br />
