Findings of the <br />Colorado Mined Land Reclamation Division <br />for <br />Twin Pines No. 2 Mine <br />Explanation of Findings <br />Pursuant to Rule 2.07.6(2) of the Regulations of the Colorado Mined Land <br />Reclamation Boarci for Coal Mining, the Mined land Reclamation Division or the <br />Board must make a number of written findings prior to issuance of a permit. <br />These findings are based on information made available to the Division <br />demonstrating that the applicant will be able to operate in compliance with <br />the Colorado Suri'ace Coal Mining Reclamation Act and the Regulations <br />promulgated pursuant to the Act. <br />The Findings Document is organized according to the major disciplines reviewed <br />during the permil;ting process. The written findings which must be made by the <br />Division are addressed under the appropriate discipline subtitle. For <br />example, findings concerning the protection of endangered or threatened fish <br />and wildlife species will be found under the subtitle of Fish and Wildlife. <br />Also, any specifiic approvals required to be made by the Division pursuan to <br />Rule 4 and thus requiring a written finding pursuant to Rule 2.07.6 (2)(m) are <br />discussed under t:he appropriate discipline subtitle. <br />Corresponding sec: tions of the original Findings Document are hereby <br />incorporated by reference into this document. <br />a1, Financial, and Compliance Information - Rules 2.03, 2.07.6 <br />Sections 2.03.4 (Identification of Interests), 2.03.5 (Compliance Information) <br />and 2.03.6 (Right: of Entry and Operation) were updated in the permit renewal <br />application in June, 1989. These modifications are on pages 1, la-1 o, and 2 <br />of the permit application. There have been no further changes to this section. <br />The application is in compliance with the requirements of this section. <br />II. Land Use - F;ules 2.04.3, 2.05.5 and 4.16 <br />Information in the original Findings Document regarding land use is still <br />accurate. Stipulation No. 6 to the approval of the original permit and <br />dealing with reve~getation success standards is discussed in Section XI of this <br />document. <br />The county road accessing the mine has been removed from the permit area and <br />is now being maintained by Fremont County. This road will be left as part of <br />the post mining land use. This change was approved as Technical Revision 02 <br />on August 28, 19E;7. <br />The operation is in compliance with the requirements of this section. <br />-5- <br />
