Recommendation <br />I recommend termination of Federal permit CO-0006, issued on December <br />30, 1981, for the Peabody Coel Company Seneca II mine. My <br />recommendation is based on the existence of the Colorado cooperative <br />agreement which provides for the delegation to the Colorado Idined Land <br />Reclamation Division (NERD) of the permitting respansibilitiea for <br />operations on Federal lands pursuant to Section 523 of the Surface <br />Mining Control and Reclamation Act (SMCRA); the issuance of the <br />Colorado State permit C-BO-005 in accordance with the Colorado State <br />program and cooperative agreement; incorporation of all necessary <br />Federal permit conditions in the State permit; and the approved mining <br />plan for Federal leases, C-19885 and C-088199• Attached to this <br />memorandum are the applicable standard conditions of approval of the <br />Seneca II mine mining plan approved by the Assistant Secretary on <br />December 29, 1981, for Federal leases C-19885 and C-088199• These <br />conditions were previously incorporated in the Federal permit. <br />Notxithstanding the termination of the Federal permit, these <br />conditions xill remain in £ull force and effect. <br />Colorado MLRD has reviewed the permit application package (PAP) for <br />the Seneca II mine under the Colorado State program and cooperative <br />agreement (30 CFP. 906.30) and has issued Colorado permit C-80-005 <br />authorizing surface coal mining and reclamation operations on Federal <br />and non-Federal lands in the permit area pursuant to the State program <br />and cooperative agreement.
