The Federal permit was <br />terminated in accordance with OSMRE'e Directive on the Termination of Federal <br />Permits because the State has a cooperative agreement that delegates the <br />permitting responsibilities on Federal lands to the State, and Colorado Mined <br />Land Reclamation Division (NERD) has issued State permit C-80-005 for the <br />Seneca II mine in accordance xith the Colorado State program and cooperative <br />agreement. <br />I have enclosed the memorandum terminating the Federal permit. Attached to <br />the memorandum are the applicable standard conditions of approval of the <br />Seneca II mine mining plan approved by the Assistant Secretary on December 29, <br />1981, for Federal leases C-19885 and C-088199. These conditions rare <br />previously incorporated in the Federal permit. Notwithstanding the <br />termination of the Federal permit, these conditions remain in full force and <br />effect. <br />Colorado MLRD is now the regulatory authority for surface coal mining and <br />reclamation operations on Federal lands at the Seneca II mine under the <br />Colorado State permit C-80-005, the Colorado State program, and the <br />cooperative agreement.
