This permit termination is categorically excluded from the National <br />Environmental Policy Act (NEPA) process because the Federal permit and <br />mining plan approval were previously covered by the NEPA process (i.e., <br />OSMRE's Environmental Assessment and Finding of No Significant Impact <br />dated December 9, 1981) <br />II. Background <br />The Seneca II surface coal mine is located in Routt County, Colorado, <br />about 6 miles southeast of Hayden, Colorado. The Colorado State permit <br />area contains approximately 3375 acres, approximately 305 acres of ~ahich <br />are leased Federal coal in the mining plan area for Federal leases <br />C-19885 and C-088199. <br />The Seneca II mine mining plan was originally approved under the Federal <br />lands program on December 29, 1981, and the mine was permitted by OSMRE <br />under the Federal lands program and Colorado State program on December <br />30, 1981. Since the original approval of the mining plan, there have <br />been no mining plan modifications. <br />OSMRE's Albuquerque Field Office was consulted on November 10, 1988 and <br />has indicated that no pending enforcement actions are associated xith <br />the Federal permit for the Seneca II mine. <br />The Federal permit contained 10 special conditions of approval. <br />Special Condition 1 protects unidentified cultural resources and is <br />carried forward in the State permit as Stipulation 1 and as a standard <br />condition of the mining plan approval. <br />Special Condition 2 required submittal of overburden analysis and was <br />satisfied on January 6, 1982. <br />Special Condition 3 requires submittal of the USCS lysimeter study when <br />completed and is carried forward in the State permit as Stipulation 2. <br />Special Condition 4 required submittal of aquifer test data and xas <br />satisfied on January 6, 1982. <br />Special Condition 5 required submittal of a reclamation plan for the <br />Grassy Creek alluvium and was satisfied on January 6, 1982. <br />Special Condition 6 required submittal of shrub density standards and <br />was satisfied on January 6, 1982. <br />Special Condition 7 requires annual submittal of seed mixes and is <br />carried forward in the State Permit as Stipulation 3. <br />Special Condition 8 required seeding of haul road embanlanents and was <br />satisifed is the Fa11 1981. <br />
