• - 35 - • <br />6.2 The monitoring program shall include, among <br />other things, a provision for monitoring the impact of <br />the Project upon the cost and availability of housing <br />fo; senior citizens residing in the County and a pro- <br />vision for making monthly estimations of the project- <br />related population. <br />ARTICLE VII <br />ENFORCEMENT <br />7.1 This Agreement and all the terms and conditions <br />thereof shall be incorporated by reference in a Special Use <br />Permit, to be issued by the County as expeditiously as may <br />lawfully and feasibly be done. When so incorporated, the <br />provisions of this Agreement shall be enforceable pursuant <br />to the provisions of that Permit and any laws, regulations, <br />or ordinances relevant thereto, and shall be subject in <br />all respects to the provisions of such laws, regulations, <br />and ordinances. <br />7.2 Notwithstanding the provision of paragraph 7.1 <br />above, in the event of default by taestern-Utah with respect <br />to any obligation hereunder, any Governmental Entity may <br />proceed by appropriate court action or actions either at <br />law or equity to enforce performance by Western-Utah of <br />the applicable covenants and terms of this Agreement and <br />to seek such other relief as may be appropriate, including, <br />without limitation, reasonable attorneys' fees and court <br />costs which that Governmental Entity shall have sustained <br />by reason of the occurence of any such default. <br />
