• - 33 - • <br />ARTICLE VI <br />MONITORING' <br />6.1 This Agreement requires the development and <br />implementation of an on-going monitoring process that <br />will allow the parties to make appropriate adjustments <br />in their responsibilities and obligations under the terms <br />and conditions of the Agreement. Accordingly, a monitor- <br />ing program shall be established as follows: <br />(a) Within thirty (30) days of the execution <br />of this Agreement, Western-Utah and the Rio Blanco Board <br />of County Commissioners shall each select a consultant; <br />such consultants to work together to develop a monitoring <br />program designed to be used in the implementation of this <br />Agreement. The consultants shall report back to Western- <br />Utah and the County within ninety (90) days of the date <br />of execution of this Agreement with a recommended monitor- <br />•~ ing program. In the event the County and western-Utah <br />cannot agree on the recommended monitoring program, the <br />dispute resolution provisions to be agreed upon in accor- <br />dance with Article VIII of this Agreement shall be invoked. <br />Western-Utah shall pay all costs incurred in developing <br />the monitoring program. <br />(b) Once the monitoring program is in place, <br />Western-Utah shall pay the sum of Sixty Thousand Dollars <br />($60,000.00) per annum to the County Planning Department <br />of Rio Blanco County to cover the monitoring costs asso- <br />ciated with the monitoring program established pursuant <br />to this Agreement as it applies to each of the Govern- <br />mental Entities. If monitoring costs should exceed <br />Sixty Thousand Dollars ($60,000.00) per annum, Western- <br />Utah will pay one-half .of the amount by. which the total <br />
