,~ <br />- zo - ~:. <br />3.10 To ensure that Western-Utah and Deseret, <br />through Western-Utah, fulfill their obligation to pro- <br />vide financial resources sufficient to allow expansion <br />of..the public utility (water and sewer) services re- <br />ferred to in paragraph 3.9 of this Agreement, Western- <br />Utah agrees that at such time as the Town of Rangely, <br />using sound management principles, determines that an <br />expansion of. public utility facilities is necessary, <br />Western-Utah shall pay to the Town of Rangely an amount <br />equal to the sum of the current State of Colorado state <br />standards for capital cost of water system improvements <br />($1,250.00 per capita) and the current State of Colorado <br />standards for capital cost of sewer system improvements <br />($1,000.00 per capita), or a total of Two Thousand Two <br />Hundred and Fifty Dollars ($2,250.00) per capita, multi- <br />plied by fifteen hundred (1500) persons, or a total of <br />Three Million Three Hundred Seventy-Five Thousand Dollars <br />($3,375,000.00), such amount to be adjusted for infla- <br />tiori;~provided, however, that the obligation set forth <br />in this paragraph shall, if appropriate, be adjusted in <br />accordance with paragraphs 3.11, 3.12 and 3.13 and of <br />this Agreement and shall be fulfilled in accordance with <br />paragraph 3.19 of this Agreement. <br />3.11 In the event that prior to the time the <br />Town of Rangely determines to undertake any public <br />utility capital improvement contemplated by paragraph <br />3.10 of this Agreement, the State of Colorado state <br />standards for the capital cost of water and sewer system <br />improvements shall have been modified from those cur- <br />rently in effect, the most recent State of Colorado state <br />standard for each such type of capital improvement, as ad- <br />justed for inflation, shall be used to compute western- <br />Utah's obligation under paragraph 3.10 of this Agreement. <br />
