- 21 - <br />3.12 In the event that prior to the time the <br />town of Rangely determines to undertake any public util- <br />ity improvement contemplated by paragraph 3.10 of this <br />Agreement, it shall have been determined in accordance <br />with the monitoring program described more fully in <br />Article VI of this Agreement that the peak project- <br />related population has exceeded fifteen hundred (1500) <br />persons, Western-Utah's obligation pursuant to para- <br />graph 3.10 of this Agreement shall be adjusted upwards <br />to take account pro rata of the peak project-related <br />population theretofore determined. <br />3.13 As part of the monitoring program described <br />more fully in Article VI of this Agreement, it shall be <br />determined on a quarterly basis whether the peak project- <br />related population is in excess of the higher of that <br />determined in accordance with paragraph 3.10 of this <br />Agreement or of that determined in accordance with para- <br />graph 3.12 of this Agreement. If as part of the monitor- <br />ing program it is determined that the peak project- <br />related population is or has been greater than that de- <br />termined in accordance with paragraph 3.10 or paragraph <br />3.12 or this paragraph of this Agreement, Western-Utah <br />shall pay to the Town of Rangely within thirty (30) days <br />an amount determined by multiplying the difference be- <br />tween the peak project-related population subsequently <br />determined and the peak project-related population <br />previously used to determine the payment pursuant to <br />paragraph 3.10 of this Agreement times the per capita <br />amount determined in accordance with paragraphs 3.10 or <br />3.11 of this Agreement, as adjusted for inflation. <br />
