<br />Memo to PCPC <br />December 11,1995 <br />Special Use Permit No. 570 (?nd Amended) <br />Page 2 <br />BACKGROUND <br />The Pueblo County Planning Commission (PCPC) originally approved Special Use <br />Permit No. 570 in December, 1985. On January 28,1986, the PCPC approved an <br />amendment to this permit regarding access, configuration of the extraction azea, and <br />location of the batch plant. The PCPC approved one-year reviews of Special Use Permit <br />No. 570 in January 1987, March 1988, and Mazch 1989. <br />In a letter dated November 11, 1994, the applicant requested this Special Use Permit be <br />revised. The PCPC approved the second amendment of Special Use Permit No. 570 on <br />December 20,1994 with the following conditions (Exhibit 3): <br />The applicant shall provide the Department of Planning and Development with a <br />copy of any and all local, state, or federal applications, permits, or amendments <br />pertaining to SUP No. 570 (2nd Amended) within 30 days of their submittal or <br />approval, This includes, but is not limited to, NLRB, 404/401, water well, air <br />quality, NPDES permits, and plans for augmentation. <br />2. Special Use Permit No. 570 (2nd Amended) shall be placed on a one-year review. <br />ZONING AND LAND USE <br />The property and surrounding property are in an A-1, Agricultural (minimum 40 acre) <br />Zone District. To the north, on the other side of Highway 96 East, the property is zoned <br />I-2, Light Industrial. To the east the area consists of an A-2, Agricultural (minimum 5 <br />acre) Zone District and an A-4, Agricultural (minimum 0.5 acre} Zone District. Also, a <br />B11, Neighborhood Business District is located neaz the intersection of 36th Lane and <br />Highway 96 East (Exhibit 4). <br />The property consists of a batch plant azea and a gravel pit azea. The Colorado <br />Interstate Gas Company is located to the north of the batch plant. The surrounding <br />land use consists ofsingle-family residences and farmland. <br />FIRE PROTECTION <br />The property is located within the Pueblo Rural Fire District service azea. <br />FLOODPLAIN <br />The batch plant portion of the property does not lie within a "Special Flood Hazazd <br />Area," however a majority of the sand and gravel pit azea does, based on FEMA's <br />
