HART <br />COUNTY ATTORNEY <br />SUBJECT: SPECIAL USE PERMIT N0.570 (2ND AMENDED), SOUTHWEST <br />READY MIX, INC., C/O JOHN SLIMAN, 37400 HIGHWAY 96 EAST <br />PURPOSE <br />This is a one-year review of the second amendment to Special Use Permit No. 570 <br />which allows the extraction and processing of natwal deposits and the operation of a <br />concrete batch plant in an A-1, Agricultural (minimum 40 acre) Zone District. The <br />applicant requested a second amendment to increase the sand and gravel pit azea from <br />75 acres to 364.88 acres and the concrete batch plat area from 54 acres to 76.31 acres <br />(Exhibit 1). <br />LOCATION <br />The concrete batch plant is located 0.5 miles east of 36th Lane on the south side of <br />Highway 96 East. The sand and gravel pit is located east and southeast of the concrete <br />batch plant azea. The azea utilizing the special use permit is legally described as a <br />portion of the NE1/4 of Section 33; a portion of the Sl/2 of Section 34; and a portion of <br />the SWl/4 of the SWl/4 of Section 35, Township 20 South, Range 63 West; and a <br />portions of the Nl/2 of Section 2 and Section 3, Township 21 South, Range 63 West of <br />the 6th P.M.
